Consider adoption of Ordinance 2009-52, setting the tax rate for the 2009 tax year at <br />53.02¢ on each $100 of taxable value of real and personal property that is not exempt from <br />taxation; leaving taxes for the use and support of the municipal government of the City for <br />the fiscal year beginning October 1, 2009, and ending September 30, 2010• providing a <br />sinking fund for the retirement of the bonded debt of the Citv; includine procedural <br />provisions; and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Bose, the City Council voted five (5) for and none (0) opposed, to approve that a <br />property tax rate be increased by the adoption of a tax rate of $0.5302 per $100 of assessed <br />valuation, which is effectively a 0.72 percent increase in the tax rate. The motion carried <br />unanimously. <br />25. Consider an ordinance amending Section 2.021 of the San Marcos City Code to change <br />the timing of evaluations of the City Managrer, Citv Attornev, Presiding Judee, and City <br />Clerk from the first quarter to the third quarter of each City fiscal year; repealing Section <br />2.022 which has been superseded by Chapter 55 pertaining to the Municipal Court of <br />Record, repealine Section 2.023 as conflictine with Section 4.02 of the San Marcos City <br />Charter which provides for the direct appointment of the City Clerk by the City Council; <br />including procedural provisions; and providing an effective date, and consider ordinance . <br />on the first of two readings. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Porterfield, the City Council voted five (5) for and none (0) opposed, to approve the ordinance <br />on the first of two readings. The motion carried unanimously. <br />26. Discussion on the San Marcos Habitat Conservation Plan and provide direction to staff. <br />Rodney Cobb, Director of Community Services, stated that this has been in the process of many <br />years. Each proposal that has been submitted to Fish and Wildlife has been returned with more <br />changes. He reported that we have been approached by the Edwards Aquifer RIP to develop a <br />habitat conservation plan for the San Marcos River, and we have been told that if developed it <br />and rolled it into their HCP, then Fish and Wildlife would approve it in 2013. He has visited <br />with Texas State University, and they are supportive of rolling their portion of the HCP into this. <br />The City Council directed staff to proceed. <br />27.
