Mr. Patterson stated the City and TxDOT would look at the <br />curb cut, and only one curb cut on Ranch Road 12 is proposed. Mr. Cox <br />stated his concern is if a location is to be a viable commercial <br />designation, it would need to have sufficient access and wanted to know if <br />safety was an issue at this location. Mr. Patterson stated the curb cut <br />could be handled through the platting process and mentioned the <br />possibility of an internal driveway use, such as Red Lobster and Chili's <br />shares. Ms. Hughson stated she did not want there to be any curb cut <br />unless the Council could be shown a good location. Mr. Cox inquired if <br />discretion of the curb cut would be at the Planning and Zoning and Staff <br />level, and if safety would be a criteria in allowing the curb cut. Mr. <br />Patterson stated safety would be a major criteria and would be looked at <br />closely for an acceptable location. On roll call of Ms. Hughson's <br />amendment, the following vote was recorded: <br />AYE: Mihalkanin, Montoya, Hughson. <br />NAY: Chiu, Cox, Mayhew. <br />ABSTAIN: None. <br />The motion failed. The Council then voted unanimously for approval of the <br />Ordinance on first reading. <br />Mayor Chiu introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> APPROVING THE RELEASE AND CONVEYANCE OF A IS FOOT UTILITY EASEMENT <br /> ACROSS A PORTION OF PROPERTY LOCATED AT 134 WEST HILLCREST DRIVE; <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE RELEASE AND CONVEYANCE; <br /> AND DECLARING AN EFFECTIVE DATE. <br />Ms. Hughson moved for approval of the Ordinance on first reading and Mr. <br />Cox seconded the motion, which passed unanimously. <br />Mayor Chiu introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows; <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING THE CITY BUDGET ORDINANCE FOR THE 2000-2001 FISCAL YEAR TO <br /> PROVIDE FUNDING FOR THE LBJ MUSEUM OF SAN MARCOS; AND DECLARING AN <br /> EFFECTIVE DATE. <br />Mr. Mihalkanin stated that although he doesn't have a financial interest <br />he is an officer, he will abstain from voting on this matter and left the <br />Chambers during its consideration.
