<br />Regular Meeting <br /> <br />July 9,2001 <br /> <br />92. <br />Page 3 <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE ABANDONMENT OF A PORTION OF <br />THE RIGHT -OF- WAY OF HOLLAND STREET NEAR ITS INTERSECTION <br />WITH LBJ. DRIVE; APPROVING THE CONVEYANCE OF THIS RIGHT- <br />OF-WAY TO DANIEL C. ANDERSON AND MARGARET A. JORDAN; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. No one <br />wished to speak, so Mayor Chiu closed the public hearing. Mr. Cox moved for approval <br />of the Ordinance on first reading and Ms. Tatum seconded the motion. Mr. Mayhew <br />asked if there was a sedimentation pond downstream and would the City be able to access <br />it easily after the property exchange. Mr. Patterson stated there is a pond, which was <br />built in conjunction with the Hillside Ranch Park Complex, and that the City would have <br />access through a right-of-way. Ms. Hughson asked Mr. Gilley if there were plans for a <br />stop sign at North LBJ and Holland Street. Mr. Gilley referred the question to Ms. <br />Anderson who stated there were plans for a 3-way stop sign. The Council voted <br />unanimously for adoption of the Ordinance on first reading. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 86, UTILITIES, OF THE CITY <br />CODE TO ADD A NEW ARTICLE 9, CROSS CONNECTION CONTROL <br />AND BACKFLOW PREVENTION; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Cox moved for approval of the Ordinance on first reading and Ms. Hughson <br />seconded the motion. Mr. Cox asked Mr. Gilley if the City had an inventory of private <br />wells. Mr. Gilley stated the City was aware of several private wells. Mr. Cox asked if <br />we knew what the devices are going to cost. Tom Taggart stated the cost would depend <br />on which type of active device required due to the type of hazard the business represents, <br />which is described in the State Statutes. The most common line size is one to two <br />inches, and the protective device would be about $800 to $1800 installed and an annual <br />testing fee of $50 to $100. Mr. Mihalkanin asked if the City has a list of all inspected <br />businesses and would there be a written notice giving them time to make the changes and <br />budget for them. Mr. Taggart stated the City has a list and he thinks there are about 800 <br />and it would take about 1 to 1 Yz years to inspect them all. All the businesses would be <br />given a notice. Mr. Mihalkanin stated he wanted the businesses to have atleast a 3-month <br />warning. Mr. Montoya asked how many businesses would be inspected in a month. It <br />was noted that recent construction should already have these devices in place. Mr. <br />Taggart stated the new businesses are already being inspected annually and sending in <br />their records. The Council voted unanimously for approval of the Ordinance on the first <br />reading. <br />
