<br />Regular Meeting <br /> <br />December 10, 2001 <br /> <br />187. <br />Page 13 <br /> <br />wanted a delay to the first meeting in January. Mr. Mihalkanin then moved <br />to table the Resolution until January 14, 2002 and Mr. Montoya seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration Item 25 removed from the consent <br />agenda, adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN EXTENSION OF THE CITY'S WATER AND WASTEWATER SYSTEMS TO <br />SERVE TWO TRACTS OF PROPERTY OUTSIDE THE CITY, ONE AT 200 SPRING <br />ROAD, AND THE OTHER AT 1627 GORDON STREET; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Ms. Hughson moved for adoption of the Resolution and Ms. Tatum seconded <br />the motion. Ms. Hughson asked if the properties were contiguous to the <br />City, and Mr. Gilley stated he did not think so. The Gordon Street <br />property is for the development of multi-family units, is outside the City <br />limits, and therefore unzoned. Mr. Gilley stated this is for the <br />extension of water services. Ms. Hughson expressed concern that if this <br />request is approved that the multi-family units will be considered <br />approved as well. Mr. Taylor suggested the Council deny the Resolution if <br />they want to review the matter. There is no zoning to prohibit this <br />development, and approval is discretionary on the part of the Council. <br />Ms. Hughson asked if one could be approved and the other denied. Ms. <br />Hughson moved to amend the Resolution to delete service to Gordon Street <br />and Mr. Mayhew seconded the motion. Mr. Cox asked if there was another <br />source of water they could connect to, and Mr. Gilley advised they are in <br />the City's service area. Mr. Cox stated this may not be in the City's <br />best long-term interest to deny service. Ms. Hughson withdrew her motion <br />to amend and Mr. Mayhew withdrew his second. Ms. Hughson then moved to <br />table the Resolution to December 17 and for Staff to bring further <br />clarification and Mr. Mayhew seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Chiu introduced for consideration Item 28 removed from the consent <br />agenda, approval of Change Order No.6 to the Construction Contract with <br />Du-Mor Enterprises, in the amount of $36,185.00 regarding construction of <br />Bishop, Belvin Street 12" Wastewater and Miscellaneous Water Transmission <br />Improvements. Mr. Cox moved for approval and Ms. Hughson seconded the <br />motion. Mr. Mayhew asked Ms. Anderson about the number of change orders <br />and increase in the total contract price. Ms. Anderson stated state law <br />does not allow a contract to exceed 25% of the original contract amount. <br />The Council then voted unanimously for approval of Change Order No.6 (Mr. <br />Montoya not present to vote on this item). <br /> <br />Mayor Chiu introduced discussion items. Due to <br />meeting, the City Council delayed the following <br />they be placed on the December 17, 2001 agenda: <br />membership fees, (2) duplex zoning regulations, <br /> <br />the length of this <br />discussions and requested <br />(1) Activity Center <br />(3) building heights in <br />
