<br />142. <br /> <br />Special Meeting <br /> <br />November 19, 2001 <br /> <br />Page 3 <br /> <br />stated he spends his money in San Marcos and does not think anything will <br />be gained by annexing them, and this annexation should happen at a <br />different time than now. He thinks the City needs to have a better <br />estimate of what it will cost to annex. The City has indicated a need to <br />annex to control growth but this area is already grown out. He thanked <br />the two Council Members who voted against this and urged the Council to <br />vote against it. (11) Melinda Habingreither of Laurel Estates asked if <br />the City was creating a monster because they can. She stated this is a <br />litigious society and indicated this will not be over when the annexation <br />is completed, but will be the beginning. The City will be facing court <br />action. She stated this matter can be taken to court for disannexation. <br />She asked the Council not to create this monster because the City has the <br />power to do so and indicated she does not think this annexation is well <br />thought out. (12) Don Smith spoke a second time to complete his thoughts. <br />He stated he hopes all six Council Members will vote no. The City's debt <br />for annexing this area could never be paid off. He reminded the Council <br />of the words expressed earlier in the meeting during the Pledge of <br />Allegiance, "liberty and justice for allH. <br /> <br />Mayor Pro-Tern Hughson introduced for consideration removing from the table <br />and approval of an Ordinance on second reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,253 ACRES, MORE OR <br />LESS, INCLUDING LAND IN THE VICINITY OF THE 2400-3000 BLOCKS OF <br />HUNTER ROAD AND THE 100-500 BLOCKS OF MCCARTY LANE, AND THE WILLOW <br />CREEK, RIDGE AT WILLOW CREEK, RIDGE AT STONE CLIFF, LAUREL ESTATES, <br />TURKEY HOLLOW AND QUARRY SPRINGS SUBDIVISIONS (SOUTHWEST SAN MARCOS <br />TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; MAKING CERTAIN <br />FINDINGS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Chiu previously filed a disclosure affidavit-real property with the <br />City Clerk and was not present during consideration of this matter. Mr. <br />Cox moved to remove this matter from the table and consider approval of <br />the Ordinance on second reading, including the amendments in the <br />memorandum of the City Attorney dated November 16, 2001 and Ms. Tatum <br />seconded the motion. Mr. Cox stated these residents would be provided <br />voting rights and services. Mr. Mihalkanin stated it was the opinion of <br />some that this annexation was rushed. Potential annexation of this area <br />was in the recommendations of the San Marcos Horizons Master Plan, and if <br />anything, the City was behind schedule in doing so. Mr. Mihalkanin stated <br />one of the individuals speaking earlier had noted that the Council should <br />listen to the will of the people. He stated on another issue in the past <br />this same citizen wanted the City to ignore those who did not want to <br />release the City's Comanche Street water wells. Mr. Mihalkanin wanted the <br />citizens to understand this is not an easy decision, and that it would be <br />difficult for the City to annex undeveloped area West of this annexation <br />if the City does not proceed with this annexation.
