<br />57. <br />Regular Meeting <br /> <br />January 10, 2000 <br /> <br />Page 6 <br /> <br />MENTAL STATE FOR VIOLATIONS OF CHAPTER 82, TRAFFIC AND VEHICLES, OF <br />THE CITY CODE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ADDING A NEW DIVISION 3, NOISE, TO ARTICLE 3, NUISANCES, OF CHAPTER <br />34, ENVIRONMENT, OF THE CITY CODE; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES. <br /> <br />Adoption of Ordinance on third and final reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.371 OF THE CITY CODE TO UPDATE THE SCHEDULE OF <br />EMPLOYEE CLASSIFICATIONS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Adoption of Resolutions: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE LEASE OF A TRACT OF LAND AT THE SAN MARCOS MUNICIPAL <br />AIRPORT TO RUSSEL MOORE; AND DECLARING AN EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO.4 TO THE <br />DEVELOPMENT INCENTIVE AGREEMENT BETWEEN THE CITY AND DOUBLE EAGLE <br />VENTURES, INC. FOR THE CONWAY ADDITION SECTION 4 DEVELOPMENT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT ON BEHALF OF <br />THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />(Ms. Hughson abstaining to the preceding Resolution). <br /> <br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF <br />OBLIGATION. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE WAIVER OF PERMIT AND INSPECTION FEES FOR THE <br />COMPREHENSIVE ENERGY ASSISTANCE PROGRAM ADMINISTERED BY COMMUNITY <br />ACTION, INC. OF HAYS, CALDWELL AND BLANCO COUNTIES; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Moore introduced for consideration approval to set the first Regular <br />Meeting date in March. Some Council Members will be attending the <br />National League of Cities Conference in Washington, D.C. on March 13. Ms. <br />Hughson moved to set the first Regular Meeting date in March for Monday, <br />March 6 and Mr. Doiron seconded the motion, which passed unanimously. <br /> <br />Mayor Moore introduced a discussion regarding possible funding for the LBJ <br />Museum. It was consensus of Council to agendize an action item at the <br />next meeting to provide $1,000 funding from the Hotel/Motel Tourist <br />Account. <br /> <br />Mayor Moore introduced a discussion regarding bonds for the Downtown <br />Improvements. Mr. Mihalkanin expressed an interest in considering <br />Certificates of Obligation or a Bond Election to complete the downtown <br />revitalization project. Mr. Gilley indicated $1.3 million is needed to <br />complete the downtown square, and this would not impact the overall debt <br />service of the City much. If the City let the bid to one contractor for <br />this project, the disruption to downtown businesses could be minimized by <br />doing the project over a period of time. Mr. Gilley stated the interest <br />rates are pretty favorable at this time. Mr. Cox indicated the Council <br />has committed to this project and that if CDBG funds are used, there would <br />be no cost to the City. Mr. Gilley stated if the work is done in multiple <br />contracts, the City may incur some inflationary costs. Mr. Doiron stated <br />if bonds were issued for the downtown project, all the downtown issues <br />could be addressed in one package as long as it was not excessive and <br />indicated he wanted a connection of the river parks downtown.
