Regular Meeting January 24, 2000 Page 3 <br />72. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. <br />Mayor Moore introduced a public hearing regarding an Annexation Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 53.989 ACRES, MORE OR <br />LESS, LOCATED ADJACENT TO THE 5000 AND 5100 BLOCKS OF INTERSTATE <br />HIGHWAY 35 SOUTH; APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING <br />FOR PUBLICATION; AND DECLARING AN EFFECTIVE DATE. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. <br />Mayor Moore introduced a public hearing regarding an Annexation Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING <br />LESS, LOCATED ADJACENT TO AND NORTHWEST OF BLOC <br />THE TANGLEWOOD ADDITION, OFF OF THE 200 AND 300 <br />DRIVE; APPROVING A SERVICE PLAN FOR THIS TRACT; <br />PUBLICATION; AND DECLARING AN EFFECTIVE DATE. <br />SAN MARCOS, TEXAS, <br />35.43 ACRES, MORE OR <br />K 1 OF SECTION 5 OF <br />BLOCKS OF OAK RIDGE <br />PROVIDING FOR <br />Ms. Hughson stated she had filed an affidavit of disclosure-real property <br />with the City Secretary and left the Council Chambers during this item. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. <br />Mayor Moore introduced a public hearing regarding an Annexation Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 55.02 ACRES, MORE OR <br />LESS, LOCATED ADJACENT TO AND NORTH OF THE 1800 BLOCK OF RANCH ROAD <br />12; APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR <br />PUBLICATION; AND DECLARING AN EMERGENCY. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />John McBride asked if this was Randall Morris' property that he would <br />place high density apartments on, and what was the purpose of annexing? <br />Mr. Gilley advised the City received a request to annex the property. <br />Ulysses Allen advised he requested the property be annexed and that <br />Randall Morris wants to do a development project on this property. Mr. <br />Patterson advised the development proposal is to do a subdivision master <br />plan clustering development wherein most of the development will be on 15 <br />acres, leaving the remainder green. Once the property is annexed, the <br />Council will separately consider the zoning request. There is no <br />connection between the annexation process and zoning. Mr. McBride asked <br />if there was some value to the City for the property to be annexed, and <br />Mr. Taylor advised the City has more regulatory control when property is <br />annexed into the City. Mr. McBride expressed concern for the <br />environmental impact this property may have and if the property was in <br />violation now and if the City would become responsible once the property <br />is annexed. Mr. Taylor advised the owner of the property would be <br />responsible. Mr. McBride asked if the property is clean, and Mr. <br />Patterson stated the owners of the property are aware an environmental <br />study will be done. No one else wished to speak and Mayor Moore closed <br />the public hearing. <br />Mayor Moore introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows:
