Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 55.02 ACRES, MORE OR LESS, LOCATED ADJACENT TO AND NORTH OF THE 1800 BLOCK OF RANCH ROAD 12; APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENCY. Mr. Hernandez moved for adoption of the Ordinance on emergency and Mr. Cox seconded the motion. On roll call the following vote was recorded: AYE: Moseley, Cox, Hernandez, Mihalkanin, Doiron, Moore. Mayor Moore introduced for consideration adoption,of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 94, DEVELOPMENT STANDARDS, OF THE CITY CODE TO ADD A NEW ARTICLE 6, EDWARDS AQUIFER PROTECTION REGULATIONS; AMENDING CHAPTER 110, SUBDIVISIONS, OF THE CITY CODE TO DELETE PROVISIONS RELATED TO THE EDWARDS AQUIFER RECHARGE ZONE AND TO MAKE OTHER CONFORMING AMENDMENTS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. Mr. Mihalkanin moved for approval of the Ordinance on first reading (not on emergency) and Mr. Cox seconded the motion. Discussion ensued. Betty Starling stated her two concerns were the procedure of the amending process and the content of the Ordinance. Ms. Starling read her handout to the Council into record and expressed her disapproval. John Boswell stated Dr. Barrett believes the Edwards Aquifer can be protected. Jon Cradit stated the Edwards Aquifer can be contaminated as well as the City's groundwater and scientific work has been provided. Lex Ray stated for the Council to consider stricter impervious cover-regulations. Mr. Taylor stated the City's Ordinance is stricter than TNRCC. Don Garrett stated the quality of the water needs to be protected by some other means as well as the rights of the citizens. Sherwood Bishop stated the Ordinance needs to include some protection for a transition zone. Lisa Schulle from the US Fish and Wildlife, stated the regulations of the Ordinance are adequate and many projects are reviewed that look at the quantity and quality of the water. John McBride stated the river needs to be protected from pollution. Eileen Trainer stated her move to San Marcos was because of the river. Mark Carter stated the Council needs to support the Planning and Zoning Commission's decision. The Council then voted unanimously for approval of the Ordinance on first reading.
