On <br />roll call the following vote was recorded: <br />AYE: Mihalkanin, Hughson, Doiron, Moore, Moseley, Cox. <br />NAY: Hernandez. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 55.02 <br />ACRES, MORE OR LESS, LOCATED ADJACENT TO AND NORTH OF THE 1800 <br />BLOCK OF RANCH ROAD 12; APPROVING A SERVICE PLAN FOR THIS TRACT; <br />PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENCY. <br />Mr. Hernandez moved for adoption of the Ordinance on emergency and Mr. Cox seconded the <br />motion. On roll call the following vote was recorded: <br />AYE: Moseley, Cox, Hernandez, Mihalkanin, Doiron, Moore. <br />NAY: Hughson. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration adoption,of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AMENDING CHAPTER 94, DEVELOPMENT STANDARDS, OF THE CITY <br />CODE TO ADD A NEW ARTICLE 6, EDWARDS AQUIFER PROTECTION <br />REGULATIONS; AMENDING CHAPTER 110, SUBDIVISIONS, OF THE CITY <br />CODE TO DELETE PROVISIONS RELATED TO THE EDWARDS AQUIFER <br />RECHARGE ZONE AND TO MAKE OTHER CONFORMING AMENDMENTS; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading (not on emergency) and <br />Mr. Cox seconded the motion. Discussion ensued. Betty Starling stated her two concerns were <br />the procedure of the amending process and the content of the Ordinance. Ms. Starling read her <br />handout to the Council into record and expressed her disapproval. John Boswell stated Dr. <br />Barrett believes the Edwards Aquifer can be protected. Jon Cradit stated the Edwards Aquifer <br />can be contaminated as well as the City's groundwater and scientific work has been provided. <br />Lex Ray stated for the Council to consider stricter impervious cover-regulations. Mr. Taylor <br />stated the City's Ordinance is stricter than TNRCC. Don Garrett stated the quality of the water <br />needs to be protected by some other means as well as the rights of the citizens. Sherwood Bishop <br />stated the Ordinance needs to include some protection for a transition zone. Lisa Schulle from <br />the US Fish and Wildlife, stated the regulations of the Ordinance are adequate and many projects <br />are reviewed that look at the quantity and quality of the water. John McBride stated the river <br />needs to be protected from pollution. Eileen Trainer stated her move to San Marcos was because <br />of the river. Mark Carter stated the Council needs to support the Planning and Zoning <br />Commission's decision.
