2. <br />Regular Meeting February 28, 2000 Page 2 <br />Mayor Moore introduced for consideration two appointments to the Human Development <br />Commission. Ms. Hughson moved to appoint Tabby De La Cruz to complete a vacancy, which <br />passed unanimously. The ETJ position will come back on March 6, 2000. <br />Mayor Moore introduced for consideration one appointment to the Drainage Advisory Board. <br />Mr. Doiron did not have his nomination at this time and this will be rescheduled for March 6, <br />2000. <br />Mayor Moore introduced for consideration one appointment to the San Marcos Industrial <br />Development Corporation. There were no nominations at this time and will be rescheduled for <br />March 6, 2000. <br />Mayor Moore introduced for consideration one appointment to the Convention and Visitors <br />Bureau. Ms. Hughson moved to appoint Michael West to complete a vacancy as a Hotel Industry <br />representative, which passed unanimously. <br />Mayor Moore introduced for consideration one appointment to the Emergency Medical Services <br />Committee. Ms. Hughson moved to appoint Shirley Mullins as a City representative to complete <br />a vacancy, which passed unanimously. <br />Mayor Moore introduced for consideration three appointments to the Youth Commission. Mr. <br />Doiron did not have his nomination at this time and this will come back on March 6, 2000. Mr. <br />Moseley moved to appoint Jon Engel as San Marcos Hispanic Chamber representative and Mr. <br />Hernandez moved to appoint Susan Narvaiz as the Area Chamber of Commerce representative, <br />which passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and approval of an Ordinance on <br />second reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AMENDING CHAPTER 94, DEVELOPMENT STANDARDS, OF THE CITY <br />CODE TO ADD A NEW ARTICLE 6, EDWARDS AQUIFER PROTECTION <br />REGULATIONS; AMENDING CHAPTER 110, SUBDIVISIONS, OF THE CITY <br />CODE TO DELETE PROVISIONS RELATED TO THE EDWARDS AQUIFER <br />RECHARGE ZONE AND TO MAKE OTHER CONFORMING AMENDMENTS; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE <br />DATE. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Randall Morris <br />stated he has studied the Ordinance as a developer and notes there is a need for flexability, but <br />feels he can abide by it. Dan Praver stated he used to reside in Austin and Barton Springs has <br />been closed many times because of the pollution in the water and does not want that to happen to <br />the San Marcos River. Bryan Anderson stated there has been poor enforcement and there needs <br />to be strict rules enforced for this Ordinance. Allison Faucett stated for the Council to please <br />read her handout carefully before making decisions regarding the impervious cover regulations. <br />Frave Stokes stated the Ordinance needs to have balance and to consider property owners. <br />Heather Beatty, from TNRCC stated she would answer any questions the Council may have. The <br />Council discussed along with Ms. Beatty what were TNRCC's responsibilities and regulations <br />concerning the Edwards Aquifer. Ms. Beatty felt that if the Ordinance was adopted by the City <br />Council, this would help TNRCC to enforce regulations. The Council also discussed the <br />contributing zone, recharge zone and transition zone and who was responsible for inspections of <br />the transition zone. Ms. Beatty stated a qualified geologist would have to make an assessment <br />and there would only be a one time fee which should be paid by the developer. Jon Cradit, <br />member of the Development Ordinance Review Task Force, stated if the Edwards Aquifer was to <br />be contaminated it would be a great devastation to the community. Mr. Cradit feels any <br />impervious cover over 10% is detrimental to the water quality and feels that 60% of TNRCC <br />inspections are not accurate. John McBride stated the US Fish and Wildlife recommends 15% of <br />impervious cover and is that a balance or is this good for the people of San Marcos. Sherwood <br />Bishop (gave two handouts to the Council) stated that damage begins when impervious cover is
