<br />135. <br />Regular Meeting April 24, 2000 Page 2 <br />Mayor Moore introduced for consideration approval of an Ordinance on first reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AMENDING ARTICLE 2 OF CHAPTER 74 OF THE CITY CODE TO ADD A <br />NEW DIVISION 4 REGARDING OBSTRUCTIONS IN ALLEYS; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />Mr. Cox moved for approval of the Ordinance on first reading and Mr. Moseley seconded the <br />motion. Mr. Taylor stated the Council had several discussions regarding this matter and then <br />directed Staff to draft an Ordinance. The Ordinance states if a person violates this Ordinance <br />they can be taken to Municipal Court and may be fined. Ms. Hughson asked if trees are <br />considered an obstruction and Mr. Taylor replied, no. Ms. Hughson stated the individual may <br />need more than ten days to be able to remove the obstruction and Mr. Hernandez agreed that it <br />may be impossible to have all items removed within ten days. Ms. Hughson moved to amend <br />Section 74.102 (b) to strike 10 days and replace with 30 days and Mr. Hernandez seconded the <br />motion. After noting obstructions could be a safety problem, Ms. Hughson and Mr. Hernandez <br />withdrew their motion. Ms. Hughson moved to amend Section 74.104 which reads "Nothing in <br />sections 74.102 or 74.103 will affect the authority of the director of public works to summarily <br />remove an obstruction from an alley without notice..." to read "Nothing in sections 74.102 or <br />74.103 will affect the authority of the director of public works to summarily remove an <br />obstruction from an alley without prior notice..." and Mr. Hernandez seconded the motion, which <br />passed unanimously. On the main motion the Council voted unanimously for approval of the <br />Ordinance on first reading. <br />Mayor Moore introduced for consideration adoption of a Resolution, the caption which was read <br />as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE REALLOCATION OF COMMUNITY DEVELOPMENT <br />BLOCK GRANT ("CDBG") FUNDING FROM THE DOWNTOWN SIDEWALK <br />IMPROVEMENT PROJECT TO OTHER PROJECTS; AND DECLARING AN <br />EFFECTIVE DATE. <br />Ms. Hughson moved to remove from the table and Mr. Hernandez seconded the motion, which <br />passed unanimously. Mr. Moseley moved for adoption of the Resolution and Ms. Hughson <br />seconded the motion. Mr. Doiron moved for the following amendment: $100,000 to the Mitchell <br />Opportunity Center, $8,820 to the Youth Service Bureau, and $14,283 to the Greater San Marcos <br />Area Seniors Association and Mr. Moseley seconded the motion. Ms. Hughson moved to amend <br />Mr. Doiron's amendment to the following: $8,820 to the Youth Service Bureau, $25,000 to the <br />Greater San Marcos Area Seniors Association, and $89,283 to the Mitchell Opportunity Center <br />and Mr. Cox seconded the motion. On roll call for Ms. Hughson's amendment the following <br />vote was recorded: <br />A YE: Hughson, Cox, Hernandez. <br />NA Y: Doiron, Moore, Moseley. <br />ABSTAIN: None. <br />The motion failed. <br />The Council then voted on Mr. Doiron's amendment: <br />AYE: Doiron, Moore, Moseley, Cox, Hughson. <br />NA Y: Hernandez. <br />ABSTAIN: None. <br />
