D. Where a transporiation impact assessment demonstrates a degradation of overall intersection <br />level of service below the existing intersection operating level or where the existing intersection is operating at a <br />level of service F, the proposed site plan or subdivision may be approved provided that a traffic mitigation plan is <br />submitted. <br />E. The traffic mitigation plan shall identify capital projects and phasing strategies that would bring the development <br />impact to within a reasonable and adequate level as determined by the Responsible Official. This plan may identify <br />improvements undertaken by the private sector, the public sector or both. Factors to be considered by the <br />Responsible Official include whether: <br />1. The cost of the mitigation measures exceeds the value of the proposed development; <br />2. Transportation demand strategies including multi -modal improvements are included; and <br />3. Alternative access strategies are evaluated and considered such as new street connections. <br />F. Pedestrian, and Streetscape Improvements. <br />1. Pedestrian and streetscape Improvements are required and determined adequate when the proposed <br />development meets the requirements of the new streets under Section 3.7.1.1 or existing streets under Section <br />3.8.1.1. <br />Section 3.5.2.11 City Facilities Participation <br />B. Escrow Policies and Procedures <br />1. Request for Escrow. Whenever this Development Code requires a property owner to construct a street, road or <br />thoroughfare, or other type of public improvement, the property owner may petition the City to construct the <br />improvement at a later time, in exchange for deposit of escrow as established below, if unusual circumstances <br />exist, such as a timing issue due to pending improvements by another agency such as TXDOT or the county, that <br />would present undue hardships or that would impede public infrastructure coordination or timing. If more than <br />one street, road or thoroughfare must be constructed in order to meet adequacy requirements for roadways, <br />the Responsible Official may prioritize roadways for which escrow is to be accepted and require the deposit of <br />all funds attributable to the development in escrow accounts for one or more of the affected roadways. The <br />Responsible Official shall review the particular circumstances involved and may require a <br />transportation irrapact assessment. The Responsible Official shall determine whether or not provision of <br />escrow deposits will be acceptable in lieu of the property owner's obligation to construct the street or <br />thoroughfare. <br />Exhibit B Pg. 27 of 27 <br />
