<br /> 52. <br /> Regular Meeting October 9, 2000 Page 4 <br /> Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br /> Jack Weatherford stated he has negotiated for six years on the development <br /> of his property, and the Planning and Zoning Commission has recommended <br /> this land use, and hopefully the zoning afterwards will be approved. John <br /> McBride stated he is opposed to this land use change. He prefers the City <br /> consider Ron Patterson's proposed Option 8. He thinks there are <br /> differences that still need to be addressed, and this property needs PDD <br /> zoning. Camille Phillips stated she supports John McBride's comments and <br /> wants the Council to deny this land use if the property is not zoned PDD. <br /> The Wonder World extension will mean RR12 will be less than an arterial <br /> road. The businesses at Crestwood have changed over numerous times, and <br /> there needs to be a better solution for this development. Rolland <br /> Hesalroad representing the Greater Castle Forest Neighborhood stated much <br /> has been said in prior meetings regarding this area. He wants everyone to <br /> consider how this development will impact future generations. Sherwood <br /> Bishop stated there is no guarantee there will not be apartments on this <br /> tract, and the area residents do not want more apartments. He stated <br /> Option 8 Mr. McBride mentioned earlier is a good option. He asked the <br /> Council not to approve this item. Joe Schneider stated he is a landowner <br /> within 200 feet of this property and is opposed to this land use change. <br /> No one else wished to speak, so Mayor Chiu closed the public hearing. Mr. <br /> Doiron moved for adoption of the Resolution and Mr. Moseley seconded the <br /> motion. Ms. Hughson inquired where the 30 foot strip to be public land is <br /> proposed, and Mr. Gilley stated it will serve as a buffer adjacent to <br /> Ranch Road 12 along the property line, or could be dedicated to the City <br /> to be zoned Public. Ms. Hughson stated to Dr. Weatherford the medium <br /> density would allow for apartments. Mr. Patterson stated the City has a <br /> subdivision master plan on file for this property. Ms. Hughson pointed <br /> out that many times land use and zoning matters are done simultaneously, <br /> and this one is not. Mr. Cox asked Mr. Gilley if the land use matter <br /> before the Council would guarantee there will be no apartments built at <br /> this location, and Mr. Gilley stated no, that medium density allows for <br /> some multi-family development. Mr. Cox asked how the buffer along Ranch <br /> Road 12 would work. Mr. Patterson replied under the City's existing curb <br /> cuts, the Weatherford project would allow for multiple curb cuts. Mr. <br /> Doiron stated Dr. Weatherford is saying he will not put up apartments, and <br /> the City should take him at his word as a gentleman. The zoning is still <br /> to come and the City will still regulate what is placed on the land. Mr. <br /> Doiron stated the Council is not going to allow apartments when the <br /> neighborhood has stated they do not want them. Mr. Gilley stated the <br /> Planning and Zoning Commission considered the commercial request. In <br /> order to change the zoning, the zoning needs to be reconsidered by the <br /> Planning and Zoning Commission, but is not a substantial enough difference <br /> from the original request that has already been denied. If this land use <br /> is approved, this would allow Dr. Weatherford's zoning to move forward <br /> with the Planning and Zoning Commission. This commercial development <br /> would be 10 acres as compared to Crestwood being 2 to 3 acres. Mr. Cox <br /> asked Mr. Patterson what businesses would be allowed, and Mr. Patterson <br /> stated most retail businesses would be allowed on commercial property, and <br /> limited business zoning would not allow drive-through types of businesses <br />
