No new or restructured si,~n may include an <br />Animated or CEVM sign. <br />(e) Restrictions on New Signs. <br />(1) This subsection applies to new off-premise signs in all areas of the City <br />and the City's extraterritorial jurisdiction. It is the intent of this subsection that the <br />total number and total area of off-premise signs not be increased in areas of the <br />City and the City's extraterritorial jurisdiction above the total number and total <br />area of off-premise signs that are lawfully in existence and listed on the initial <br />registration forms filed under subsection (h) by September 30, 2003. <br />(2) A permit will be issued to erect a new off-premise sign in a permissible <br />location only if the applicant first removes one or more existing off-premise signs <br />with a total area equal to or greater than the total area proposed for the new sign. <br />If an applicant for a new off-premise sign has one or more existing <br />nonconforming off-premise signs, the existing off-premise sign or signs removed <br />by the applicant must be nonconforming signs. If an applicant for a permit for a <br />new off-premise sign has no existing nonconforming signs, the existing off- <br />premise sign or signs removed by the applicant may be any conforming off- <br />premise signs. <br />(3) Anew off-premise sign that replaces an existing off-premise sign or signs <br />within the highway corridor must be located in a permissible location within the <br />highway corridor. An existing off-premise sign in a location outside the highway <br />corridor may be replaced with a new off-premise sign in a permissible location <br />within the highway corridor or outside the highway corridor. <br />(4) Anew off-premise sign in a location outside the highway corridor shall <br />not exceed the height of the existing sign it replaces. A new off-premise sign in <br />the highway corridor is subject to the height restrictions in subsection (d)(2) of <br />this section, and is not limited to the height of the existing sign it replaces. <br />(5) New and restructured off-premise signs shall not be located on property <br />designated as a residential or agricultural district by Chapter 4 if the property is <br />13 <br />
