<br />78. <br />Regular Meeting <br /> <br />February 11, 2002 <br /> <br />Page 4 <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 73-A, OF <br />THE SOUTHEND ADDITION LOCATED AT 701 GEORGIA STREET, FROM "P" (PUBLIC <br />AND INSTITUTIONAL DISTRICT) AND "R-1" (SINGLE-FAMILY RESIDENTIAL <br />DISTRICT [LOW DENSITY RESIDENTIAL]) TO "P" (PUBLIC AND INSTITUTIONAL <br />DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Mr. Cox moved for <br />adoption of the Zoning Ordinance and Mr. Mayhew seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Chiu introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ORDERING A GENERAL AND SPECIAL ELECTION TO BE HELD ON MAY 4, 2002 FOR <br />THE PURPOSE OF ELECTING A MAYOR, A CITY COUNCIL MEMBER, PLACE 3, AND <br />A CITY COUNCIL MEMBER, PLACE 4; TO SUBMIT PROPOSITIONS TO THE VOTERS <br />FOR PROPOSED AMENDMENTS TO THE CITY CHARTER, AND TO SUBMIT A <br />PROPOSITION TO THE VOTERS FOR THE PROPOSED LEASE OF AN AREA OF CITY <br />PARKLAND TO THE SAN MARCOS HISPANIC CHAMBER OF COMMERCE; ESTABLISHING <br />EARLY VOTING LOCATIONS AND POLLING PLACES FOR THIS ELECTION; MAKING <br />PROVISIONS FOR THE CONDUCT OF THE ELECTION; AND DECLARING AN <br />EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Ms. <br />Hughson seconded the motion. Mr. Cox stated he serves as a representative <br />of the City Council on the Hispanic Chamber of Commerce and has asked the <br />City Attorney, Mark Taylor, if it would be a conflict for him to vote on <br />this Ordinance, and Mr. Taylor has advised him there is no legal conflict. <br />Ms. Hughson stated she is concerned about the Charter Amendment changing <br />the makeup of the Planning and Zoning Commission. Mayor Chiu stated he <br />agrees with Dr. Rogers and John Wade that ETJ representation is needed on <br />the Planning and Zoning Commission. We affect ETJ property in some way <br />and Mayor Chiu stated they need a voice on the Planning and Zoning <br />Commission. Mr. Cox stated he thinks it has worked well to have ETJ <br />representation on the P&Z Commission. He thinks it would be fair and <br />equitable for them to be given a voice. He respects the position of the <br />Charter Review Commission, but there is a case for keeping ETJ <br />representation. Ms. Hughson stated she wanted to eliminate the position <br />on P&Z that allows either a person in the City or ETJ to serve and make <br />that position a City resident, and Ms. Hughson wants the Ordinance to <br />prohibit the ETJ representative from voting on zoning matters. Ms. Tatum <br />stated she thinks the ETJ needs to be represented and agrees that position <br />should not vote on zoning matters. Mr. Mihalkanin stated he does not want <br />
