Mr. Patterson stated the adoption of this Ordinance would be an advantage to the builders who will have one set of building codes to comply with regardless of their location or project and would also bring the City in compliance with State Legislation. Ms. Hughson stated she is concerned about children's safety around unsafe buildings, and the length of time allowed to keep unsafe buildings. Ms. Russell, Assistant City Attorney, stated this Ordinance would cover the required, legal process of handling unsafe buildings. Mr. Cox asked in Section 14.026 Amendments 106.3.4.5 who makes the inspections for these large types of buildings and structures. Mr. Patterson stated these types of large buildings and structures are so rare the City rarely uses this part of the code and accept the sworn affidavit from either the registered architect or engineer. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REVISING AND UPDATING ARTICLE 3, STANDARDS, OF CHAPTER 38, FIRE PREVENTION AND PROTECTION, OF THE CITY CODE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mr. Mayhew moved for approval of the Ordinance on first reading and Ms. Hughson seconded the motion. Ken Bell, City Fire Marshall, stated this Ordinance adopts the International Fire Code 2000, which has some minor changes from the Ordinance the City already has adopted. Ms. Hughson asked if the fees are new or are they due for a fee review. Mr. Bell stated this proposed Ordinance has added Section 2, which is fee related and the fees are new. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Chiu introduced for consideration the reconsideration of two Zoning Ordinances. The Council did not wish to reconsider these Ordinances. The captions of these Ordinances read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 2.9 ACRE TRACT OF PROPERTY LOCATED IN THE 1300 BLOCK OF WONDER WORLD DRIVE FROM "MF-5" MULTI-FAMILY DISTRICT (HIGH DENSITY) TO "LB" LIMITED BUSINESS DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.157 ACRE TRACT OF PROPERTY LOCATED AT THE CORNER OF CENTRE STREET AND SHADY LANE FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" SINGLE-FAMILY DWELLING DISTRICT (MEDIUM DENSITY) ; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES.
