<br />37. <br />Regular Meeting January 28, 2002 Page 2 <br />Sandra Boulden wanted to speak on the Party Ordinance and Noise Ordinance. <br />Ms. Boulden was meeting with a group of individuals interested in <br />alleviating the problems caused by parties and noise and later learned <br />Ordinances had already been developed. She wants a public hearing to be <br />held on these Ordinances to allow interchange with the Council. (5) Ron <br />Boulden is a member of San Marcos Rental Properties Association and wanted <br />to address the Party Ordinance. Mr. Boulden stated they had been meeting <br />to find solutions. He expressed concern with electrical power being <br />turned off and thought there would be a liability issue against the City. <br />He stated this could cause injury to life or property and thought this <br />provision needed to be deleted. ( 6) Tom Wassenich stated he is in support <br />of the Party Ordinance and Noise Ordinance. He stated he is in hopes the <br />Council will not weaken these Ordinances and that many think it will be <br />essential to the quality of life in San Marcos. (7) Dianna Graves stated <br />she is a member of the San Marcos Rental Property Association. She <br />expressed concern for the suspensiop of electrical service as stated in <br />the Party and Noise Ordinances. She stated this could propose a danger to <br />tenants and lawsuits could stem from this. She suggested the Ordinances <br />be tabled for there to be more time for discussion. (8) Laura Schneider <br />stated she is a member of the San Marcos Rental Property Association and <br />she is glad the City is looking at the Party and Noise Ordinances. She <br />stated the Neighborhood Association and Police Department have worked on <br />these. She stated the Noise Ordinance provides what is unlawful by <br />owners, property managers and tenants. She stated the process does not <br />continue to involve the occupants in assessing fines of breaking the law <br />and thinks the tenants need to remain involved. She stated she had talked <br />with Chief Griffith earlier today and thinks there are solutions that can <br />be worked out to write an effective Ordinance. She requested the <br />Ordinance be tabled. (9) Mark Mascio stated he works for Real Estate <br />Management Services and requested the Party and Noise Ordinances be tabled <br />and the City work with managers of property to improve the Ordinances. <br />(10) John Hohn stated he once thought of living in an apartment, but the <br />noise was so bad that he abandoned the idea . He hopes the Party and <br />Noise Ordinances will be put in place and stated there is not enough <br />police available for all the noise violations. He stated he has been <br />advised one of the Council Members owns apartments. Although the law may <br />not require the Council Member to abstain, he does not think the Council <br />Member should vote on these Ordinances. (11) Steve Uzzell of San Marcos <br />Real Estate Properties stated they are trying to enhance property values, <br />and they think the Party and Noise Ordinances are a step towards <br />improvement. They had no input with these Ordinances and want them tabled <br />until they can be involved in the solutions. <br />Mayor Chiu introduced for consideration approval of one appointment to the <br />Human Development Commission. This appointment needs to be a <br />representative of the City's extraterritorial jurisdiction. Mr. <br />Mihalkanin requested the Council be provided a map reflecting the ETJ <br />area. This appointment will be rescheduled. <br />
