<br />113. <br />Regular Meeting <br /> <br />April 22, 2002 <br /> <br />Page 2 <br /> <br />(5) Laura DaVila stated she is the neighborhood representative of <br />Mockingbird Hills. She stated she feels the Council should strengthen the <br />Sector Five Plan by zoning the lot at the end of Leah as "R-1". She stated <br />she had three requests for the Council: 1. gate the new entrance Mr. Moore <br />is proposing; 2. if an emergency gate is needed, it should be built on the <br />apartment complex property; and 3. all keys to the lock be given to <br />emergency personnel only. (6) John Sarzoza stated he wished to speak on <br />Item 21, the Sector Five Plan. He stated he feels the new area developed <br />behind Mockingbird Hills should be zoned "R-1" and the portion of Leah <br />Street, and the new development road connecting to DeZavala Street should <br />be named DeZavala Street. (7) Kyle R. Bolin stated he was representing <br />Key Moore, the prospective developer of the area mentioned in the Sector <br />Five Plan. He stated the Council should still consider the Leah to Leah <br />connection, but Mr. Moore will develop a plan in accordance with the <br />Council's decision. 8) Leslie Salas stated she is a resident of Oak <br />Heights and is in support of Item 10, providing funding for the defense of <br />the Weatherford lawsuit. Matt Janysek signed up to speak during the <br />Citizen comment period and requested to speak during Item 21 (Sector Five <br />Plan) . <br /> <br />Mayor Chiu introduced for consideration approval of one appointment to the <br />Historic Preservation Commission. Mr. Mihalkanin moved to appoint Virginia <br />Witte to complete a vacancy, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of one appointment to the <br />Convention and Visitors Bureau Board. Mr. Mihalkanin moved to appoint <br />Nick Patel to complete a vacancy, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of one appointment to the <br />Transportation Advisory Board. Mr. Mihalkanin moved to appoint Damon <br />Cherry to complete a vacancy, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of two appointments to <br />the Human Services Advisory Board. No nominations were received and this <br />will be rescheduled. <br /> <br />Mayor Chiu introduced a discussion regarding election laws and duties of <br />public officers and direction to Staff. Ms. Sherri Russell, Assistant City <br />Attorney, stated Mr. Mihalkanin and Mr. Montoya were elected as County <br />Precinct Chairs and there is a concern regarding the Constitution <br />Provision, which says if you are already elected to one office and run for <br />another office, then you must resign from the first office. Ms. Russell <br />stated the Council has requested an Attorney General's Opinion through the <br />District Attorney's Office to be sure holding both offices does not <br />violate State Law. Mr. Mihalkanin stated before he decided to run for <br />County Precinct Chair, he contacted Charles Soechting, General Counsel to <br />the Democratic Party. Mr. Mihalkanin stated both he and Mr. Soechting did <br />not feel there would be a conflict. Mr. Mihalkanin then read excerpts <br />from a letter from Hays County District Attorney, Mike Wenk, to the <br />Attorney General, quoting state laws on the issue. <br />
