He also stated the <br />proposed RFP states the contractor will provide materials for six City- <br />sponsored neighborhood clean-up events and four City-sponsored river clean- <br />up events. He stated this proposal does not include commercial accounts. <br />Mr. Mihalkanin stated he has not had time to read the entire proposal and <br />would like additional time to review. Mr. O'Leary stated delaying this <br />process may mean the Recycling Drop-Off Center and the Solid Waste contract <br />will not coincide with each other. Mr. Mihalkanin suggested the Council <br />extend the current solid waste contract for an additional month. Council <br />agreed by consensus to bring this discussion back to the Regular Meeting on <br />January 13, 2003. <br /> <br />Mayor Habingreither introduced a discussion regarding the possible Southwest <br />San Marcos Area Disannexation. Mr. O'Leary stated Staff has drafted a <br />schedule for disannexation with tight times lines. He stated he needs <br />direction on how to proceed. Mr. Mark Taylor stated disannexation of this <br />area would be a change that affects voting that would be subject to <br />preclearance under the Voting Rights Act. There would be timing issues. It <br />would require at least a 60-day review period by the Department of Justice. <br />The Department of Justice could then request an additional 60-day extension. <br />He stated this additional time would then fall after the time in which the <br />Council would need to call for the May election. Ms. Tatum stated her <br />preference is to move forward. Ms. Narvaiz stated she also feels the City <br />should move forward. Mayor Habingreither stated he feels the Council should <br />look at the sanctity of the Election process and the integrity of the City. <br />Ms. Tatum stated she is willing to wait until after the May Election to <br />ensure the integrity of the City. Mr. Mayhew agreed to delay the process <br />until after the May Election. Mr. Taylor stated he feels the Council should <br />wait until after the May Election. Ms. Narvaiz stated she was not <br />comfortable with the Council starting a discussion regarding the <br />disannexation and then stopping the process until after the May Election. <br />Mr. Mihalkanin and Mr. Montoya both stated they felt the Council should wait <br />until after the May Election. It was consensus of the Council to delay <br />consideration of disannexation until after the election. <br /> <br />Mayor Habingreither introduced the City Council's Report. 1) Mr. Mihalkanin <br />inquired as to the status of the Subdivision Ordinance process. Ron <br />Patterson, Director of Planning, stated the Consultant outlined issues which <br />need to be addressed. He stated staff needs further direction from the <br />Council. Mr. Mayhew stated this issue needs to be addressed. Mr. <br />Mihalkanin stated the process is for the Planning and Zoning Commission to <br />review before this comes to the Council. Mr. Mark Taylor suggested the Code <br />Consultants could pick up where the process stopped in September. Mayor <br />Habingreither suggested this Ordinance be divided into subsections and <br />presented at different City Council meetings. Mr. Mayhew inquired to the <br />time frame for completion. Mr. Patterson stated after Council gives <br />direction to the Staff, they will need an additional 4 to 5 months to <br />complete the draft and then provide it to the Planning and Zoning <br />Commission, and an additional 3 to 4 months for adoption.
