The Council then voted unanimously for the adoption of the <br />Ordinance on emergency. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, OF THE CITY CODE TO <br />ADD SECTION 2.375 REGARDING ATTORNEY-CLIENT PRIVILEGE AND WAIVER OF <br />ATTORNEY-CLIENT PRIVILEGE FOR THE CITY COUNCIL AND BOARDS AND <br />COMMISSIONS OF THE CITY; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mr. Mayhew moved for approval of the Ordinance on first reading and Ms. <br />Narvaiz seconded the motion. Mr. Mark Taylor stated the City does not have <br />a formal policy regarding attorney-client privilege and waiver of attorney- <br />client privilege for the City Council, or boards and commissions. This <br />Ordinance would clarify a waiver of the attorney-client privilege for the <br />City Councilor a board or commission. Requiring a waiver is in the best <br />interest of the public and would be the approval of a majority of the City <br />Councilor a board or commission. The Council then voted unanimously for <br />approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration reconsideration of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A ZONING MAP AMENDMENT FROM "MF-4" MULTI-FAMILY DISTRICT <br />(HIGH DENSITY) TO "MF-1" MULTI-FAMILY DISTRICT (LOW DENSITY) FOR A <br />2.06 ACRE TRACT OF PROPERTY LOCATED AT 322 SOUTH JOHNSON AVENUE; <br />REVISING THE FUTURE LAND USE PLAN OF THE CITY MASTER PLAN TO CONFORM <br />TO THIS ZONING MAP AMENDMENT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved to reconsider the Zoning Ordinance and Ms. Narvaiz <br />seconded the motion, which passed unanimously. Mr. Taylor moved for <br />adoption of the Zoning Ordinance and Ms. Narvaiz seconded the motion. Mr. <br />Mihalkanin stated he wished to reconsider this Zoning Ordinance because the <br />neighborhood is a single-family neighborhood that has flooded in the past. <br />He stated he is opposed to Multi-Family zoning in this neighborhood. On <br />roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Habingreither, Taylor and Mayhew. <br /> <br />NAY: <br /> <br />Mihalkanin and Montoya. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The Zoning Ordinance was adopted. <br />
