<br />106. <br />Regular Meeting <br /> <br />July 8, 2002 <br /> <br />Page 4 <br /> <br />TRACT), APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING PROCEDURAL <br />PROVISIONS; AND DECLARING AN EFFECITVE DATE. <br /> <br />Mayor Habingreither opened <br />speak. 1) Norman Starling <br />property and supports this <br />Mayor Habingreither closed <br /> <br />the public hearing and asked if anyone wished to <br />stated he owns 18 acres west of the Berry's <br />annexation. No one else wished to speak, so <br />the public hearing. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />adoption of an Ordinance on emergency, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REVISING AND UPDATING PORTIONS OF ARTICLE 3, DRAINAGE AND EROSION <br />CONTROL, OF CHAPTER 94, DEVELOPMENT STANDARDS, OF THE CITY CODE; <br />AMENDING CHAPTER 110, SUBDIVISIONS, OF THE CITY CODE TO ADD A <br />REFERENCE TO DRAINAGE, EROSION CONTROL AND WATER QUALITY REGULATIONS; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. No one wished to speak, so Mayor Habingreither closed the public <br />hearing. Ms. Narvaiz inquired why the Ordinance references the City of <br />Austin Drainage Criteria Manual and City of Austin Environmental Criteria <br />Manual, and would the City accept all future changes the City of Austin <br />makes to their manuals. Laurie Anderson, Director of Engineer, stated the <br />City of Austin's manuals provides similar soil types and rainfalls, which <br />provide a tool to follow. This is also helpful by providing consistence <br />for the Engineers who already know the Austin Manuals. Mr. Mark Taylor <br />stated since the Ordinance references the City of Austin's Manuals, if <br />Austin amends their manuals, this would automatically update this <br />Ordinance. Mr. Mayhew moved to adopt the Ordinance on an emergency, and <br />Ms. Tatum seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />reconsideration of a Zoning Ordinance, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 4.23 ACRE, <br />MORE OR LESS, TRACT OF PROPERTY LOCATED IN THE 2100 BLOCK OF IH-35 <br />NORTH, FROM "PD" PRE-DEVELOPMENT DISTRICT TO "PDD" PLANNED DEVELOPMENT <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Mihalkanin moved to reconsider the Zoning Ordinance and Mr. Mayhew <br />seconded the motion, which passed unanimously. Mayor Habingreither opened <br />the public hearing and asked if anyone wished to speak. No one wished to <br />speak, so Mayor Habingreither closed the public hearing. Mr. Mihalkanin <br />moved for the adoption of the Zoning Ordinance and Mr. Mayhew seconded the <br />motion, which passed unanimously. <br />
