Mayor Habingreither introduced for consideration a public hearing and adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REVISING AND UPDATING PORTIONS OF ARTICLE 3, DRAINAGE AND EROSION CONTROL, OF CHAPTER 94, DEVELOPMENT STANDARDS, OF THE CITY CODE; AMENDING CHAPTER 110, SUBDIVISIONS, OF THE CITY CODE TO ADD A REFERENCE TO DRAINAGE, EROSION CONTROL AND WATER QUALITY REGULATIONS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. No one wished to speak, so Mayor Habingreither closed the public hearing. Ms. Narvaiz inquired why the Ordinance references the City of Austin Drainage Criteria Manual and City of Austin Environmental Criteria Manual, and would the City accept all future changes the City of Austin makes to their manuals. Laurie Anderson, Director of Engineer, stated the City of Austin's manuals provides similar soil types and rainfalls, which provide a tool to follow. This is also helpful by providing consistence for the Engineers who already know the Austin Manuals. Mr. Mark Taylor stated since the Ordinance references the City of Austin's Manuals, if Austin amends their manuals, this would automatically update this Ordinance. Mr. Mayhew moved to adopt the Ordinance on an emergency, and Ms. Tatum seconded the motion, which passed unanimously. Mayor Habingreither introduced for consideration a public hearing and reconsideration of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 4.23 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED IN THE 2100 BLOCK OF IH-35 NORTH, FROM "PD" PRE-DEVELOPMENT DISTRICT TO "PDD" PLANNED DEVELOPMENT DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mr. Mihalkanin moved to reconsider the Zoning Ordinance and Mr. Mayhew seconded the motion, which passed unanimously. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. No one wished to speak, so Mayor Habingreither closed the public hearing. Mr. Mihalkanin moved for the adoption of the Zoning Ordinance and Mr. Mayhew seconded the motion, which passed unanimously.
