On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Hughson, Chiu, Cox, Mayhew. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Tatum, Montoya. <br /> <br />Mayor Chiu introduced for consideration Item 23 removed from the consent <br />agenda, adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN THE CITY AND FREESE & NICHOLS, INC. <br />FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE DEVELOPMENT OF THE <br />CITY WEB PAGE; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AGREEMENT <br />ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved to table this Resolution until the Regular Meeting on <br />June 10, 2002, and Mr. Mayhew seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Chiu introduced an Executive Session pursuant to the Government <br />Code, Section 551.074, to discuss the emploYment of a public officer <br />(Interim City Manager) and discuss duties of public officials (City <br />Council Members). Ms. Tatum moved the Council adjourn into Executive <br />Session at 8:49 p.m. and Mr. Mayhew seconded the motion, which passed <br />unanimously (Ms. Hughson was out the Chambers during this vote). <br /> <br />Mr. Mihalkanin moved the Council reconvene at 10:04 p.m. and Mr. Mayhew <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration Item 11 removed from the consent <br />agenda, adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPOINTING DAN O'LEARY AS INTRIM CITY MANAGER; APPROVING THE TERMS <br />AND CONDITIONS OF A LETTER AGREEMENT BETWEEN THE CITY AND DAN O'LEARY <br />FOR SERVICES AS INTERIM CITY MANAGER; AUTHORIZING THE MAYOR TO <br />EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for adoption of the Resolution, and Ms. Hughson seconded <br />the motion. Mr. Mihalkanin moved to amend A. Functions and Duties by <br />removing 1. To appoint and remove ... state law. and adding in an <br />additional Functions and Duties to read The Interim City Manager does not <br />have the authority to remove employees of the City; nor to cancel <br />vacation, sick leave, not any other leave, except when a state of <br />
