City Council Meeting Minutes February 24, 2021 <br />CONSENT AGENDA <br />A motion was made by Mayor Pro Tem Derrick, seconded by Council Member <br />Baker, to approve the consent agenda, with the exception of item #3, which <br />was pulled and considered separately. The motion carried by the following <br />vote: <br />For: 7 - Mayor Pro Tem Derrick, Mayor Hughson, Council Member Baker, Council Member <br />Gonzales, Deputy Mayor Pro Tem Scott, Council Member Garza and Council <br />Member Gleason <br />Against: 0 <br />2. Consider approval, by motion, of the following meeting Minutes: <br />A. January 19, 2021 - Regular Meeting Minutes <br />B. February 2, 2021 - Work Session Meeting Minutes <br />3. Consider approval of Resolution 2021-27R, confirming the City Manager's appointment <br />of Kathy Martinez -Prather to the San Marcos Civil Service Commission; and declaring an <br />effective date. <br />A motion was made by Council Member Baker, seconded by Council Member <br />Garza, to postpone Resolution 2021-27R. Council Member Baker would like <br />the City Manager to have more applicants in the selection and would like to <br />have the description of Civil Service Commission more transparent on their <br />charge. He would like to see this postponed until mid March. <br />Deputy Mayor Pro Tem Scott stated he has served previously because of his <br />criminal justice background. The Commission makes decision on police and <br />fire employees with testing abilities, weather staff gets the promotion and looks <br />at data and the facts of case. <br />Linda Spacek, Human Resources Director clarified the role of the commission <br />regarding officer fitness is when a chief questions the fitness of a particular <br />staff member due to the provisions in the Civil Service. The commission does <br />not set the fitness standards for the department that is the role of staff and <br />City Manager. <br />Mayor Pro Tem Derrick inquired who appoints the members and why aren't <br />they appointed by council? Ms. Spaeck stated the City Council has adopted <br />the provisions of Local Government Code 143 for Civil Service for sworn <br />police officers and firefighters. The statute forms the three member <br />commission with terms of appointment and states that members are appointed <br />by the City Manager with confirmation of City Council. Mayor Pro Tem <br />Derrick asked how are the names of candidates received? Ms. Spacek stated we <br />City of San Marcos Page 5 <br />
