Ms. Moyer stated we have had 13 per year varied in connection and <br />extension. <br />Mayor Hughson inquired about the connection vs. extension. Ms. Mattingly <br />will provide information to council. <br />Council consensus is to move forward with the redline option language and to <br />require council approval for connections and to <br />bring forth to council at a future date. <br />16. Hold discussion on the sequence for the approval process and LDC amendments for Out <br />of City Utility Extensions; and provide direction to Staff. <br />Shannon Mattingly, Director of Planning and Development Services, asked for <br />direction regarding when the Out of City Utility (OCU) will go through the <br />approval process. <br />Ms. Mattingly is seeking direction from Council regarding a possible Land <br />Development Code amendment to change on where the OCU application <br />process will begin - if it will be before other applications are accepted. <br />Mayor Pro Tem Derrick stated she likes the annexation concurrent with zoning <br />and knowing what the developer is asking for zoning and if it acceptable for <br />the area which is the current process. <br />Ms. Mattingly asked Should the out -of -city utility request be combined with a <br />Development Agreement? Or should we require annexation and zoning any <br />time there is a out -of -city utility request? The issue is that some developers <br />want city utilities but do not want to be annexed. Mr. Taggart stated this is a <br />complex issue and the developer can opt out of our CCN at will and some <br />developers are righting permits. They do not want to be annexed because they <br />do not want to follow the LDC requirements. If they are not granted access to <br />city utilities, they say they will do a "package plant." Ms. Derrick asked Mr. <br />Taggert to explain - <br />what is a package plant? Mr. Taggart responded that it is a pre-engineered and <br />pre -configured wastewater treatment facilities that are typically unattended and <br />as with any hydraulic and/or mechanical system, can fail at times. They <br />discharge into either dry or intermittent creeks that may flow through any <br />neighborhood until they get to a river.
