City Council <br />Meeting Minutes February 2, 2021 <br />sell a large portion of our high quality effluent and with regard to the proposed <br />subdivisions with who we are now having discussions, we stand to lose about <br />$8 million in potential income to our wastewater system. That type of revenue <br />can help stabilize costs for our current customers. <br />Council Member Derrick asked what is a good solution because we want to <br />protect or river, but some developers don't want to abide by our codes? It's a <br />very complex situation. Ms. Mattingly stated that currently when we grant an <br />out -of -city utility connection, we require an annexation request and a <br />development agreement. Discussion about the development agreement <br />identifies the developers requirements and helps with negotiations. She <br />reminded all that any development in the ETJ must abide by the water quality <br />portion of the land development code, even if not annexed. A big issue with <br />this process is the length of time required. <br />Mr. Taggert noted that our processes were set up before the legislature changed <br />the process for annexation, which now requires the owner/developer to request <br />annexation. Another consideration is that iVwhen the package plant fails, the <br />development may ask the city for help and to connect to the city system at that <br />time. <br />Mr. Lumbreras stated we have different process for developments occurring <br />inside and outside the city. Mr. Taggart stated an option is decoupling out of <br />city request and annexation. We need to review our priorities. <br />Mayor Pro Tem Derrick suggested to have a work session on this item. Ms. <br />Mattingly stated there is a work session schedule on similar item regarding <br />reviewing the current OCU connections and potential annexations and we <br />could tie this item to it. That work session is scheduled in March. Council <br />agreed that is a good idea. <br />Mr. Lumbreras stated he will add this item to the March work session. <br />13. Consider nominations and make an appointment to fill a vacancy on the La Cima Council <br />Committee. <br />Deputy Mayor Pro Tem Scott volunteered and was unanimously approved to <br />serve on the La Cima Council Committee. <br />14. Hold discussion and provide direction to staff related to the passage of one or more <br />emergency orders related to the current disaster declaration stemming from the <br />COVID-19 pandemic. <br />Mr. Lumbreras stated Council requested this item for discussion. <br />City of San Marcos page 20 <br />
