City Council <br />Meeting Minutes February 2, 2021 <br />stated that many people were on the meeting in the past, but they were unable <br />to control issues with quorums and the Judge made the decision to include <br />only the Hays County Mayors. <br />Council Member Baker expressed his concerns that questions are not being <br />asked about contract tracing and thinks there should be more in depth <br />conversations. <br />Council Member Baker inquired about the El Paso lawsuit. Mayor Hughson <br />stated that El Paso County placed the restrictive orders, the shutdown lasted <br />two weeks because business owners immediately filed lawsuit, and the City <br />stated they were not going to abide by the orders. Council Member Baker <br />asked about the Chamber of Commerce posting a picture of people at a <br />restaurant not wearing masks. Asked what can be done in this situation where <br />people are not wearing a mask? Mayor Hughson stated she spoke to Jason <br />Mock, President of the Chamber regarding the picture. The people arrived in <br />masks, wore their mask <br />during the event, the restaurant was taking temperatures and people had their <br />mask off while drinking/eating and back on when they left the restaurant. The <br />restaurant did follow the protocols. Mr. Stapp stated enforcement of masks is <br />a broader conversation and the Governor's order does not allow police to <br />detain an individual in order to issue citations to people not wearing a mask <br />because it could become problematic or an aggressive encounter. <br />Council Member Garza stated the intent is for the burden to be on the <br />individual to wear a mask and the businesses have the authority to ask the <br />people to leave if they choose to wear no mask. If the people do not leave, then <br />it is trespassing. Mr. Stapp <br />stated it only becomes trespassing when they have been warned to leave and <br />don't. Council Member Garza asked if other cities have ways to empower <br />businesses to enforce wearing a mask following the Governor's order? Mr. <br />Stapp stated other cities have taken different public educational outreach and <br />our Communications department has done educational outreach. <br />Council Member Baker asked if businesses can call the Police Department to <br />enforce trespassing, if customer doesn't want to wear a mask? Mr. Stapp stated <br />this has occurred at City Hall and in the end the citizen left and this would <br />apply to any business as well. They could call the non -emergency line for <br />trespassing or to escort individuals off the property. <br />Council Member Gonzales asked about funeral services running full capacity? <br />City of San Marcos Page 6 <br />
