City Council Meeting Minutes August 3, 2021 Mayor Hughson noted that our Communication staff have done a good job in the past of making this type of information available on social media and Ms. Reyes confirmed that this will continue in the future. Mayor Pro Tem Derrick asked if we mail the applications to newly organizations? Ms. Reyes stated the liaisons reach out to partners to notify them of grant opportunities. Ms. Derrick would like Ms. Insley to reach out to our Homeles coalition on funding opportunities and doesn't want them to be left out. Ms. Reyes stated staff would reach out to Ms. Insley. 27. Receive a Staff presentation and hold a public hearing to receive comments for or against and consider an appeal of the decision of the Planning and Zoning Commission to deny CUP -21-17, a request by John Mark Slack, on behalf of Mr. Exotics Steakhouse, for a new Conditional Use Permit to allow the sale and on -premise consumption. of Mixed Beverages at 101 and 105 East Hopkins Street. Amanda Hernandez, Assistant Director of Planning and Development Services, provided the Council with a brief presentation regarding the Conditional Use Permit (CUP) appeal before the Council. Ms. Hernandez stated Code Enforcement received a complaint regarding construction occurring to the interior of the building. After inspection of the property, Code Enforcement found no evidence of permits being issued for the work and staff issued a Stop Work Order on April 1, 2021. At first the applicant was not in compliance with Historic Preservation Commission and got into compliance but did not use the correct paint or trim on the exterior; staff asked them to correct this and they are in the process of applying for a building painting permit. Mayor Hughson opened the Public Hearing at 8:11 p.m. Those who spoke: David Sergi, spoke on behalf of the applicant. He stated the applicant has purchased various historic properties and their heart is in preservation. He stated the applicant, Mr. Slack, was not aware of the code and believes they desire to postpone action on this item. Mr. Sergi's stated the applicant would like to rebuild the trust in the community. Applicant wants to revitalize the building and will make it a high end steakhouse. He is available to answer questions. John Slack, applicant, echoes what Mr. Sergi stated. He would like to go through the proper process with permits to restore the building. Lisa Marie Coppoletta, spoke in opposition of the project. She expressed concern with credibility of the applicant and the project. She would like the City of San Marcos page 12
