City Council Meeting Minutes August 17, 2021 <br />and Recreation Department; and providing direction to Staff. <br />Deputy Mayor Pro Tem Scott stated there are some complications to the spear <br />gun rule. It is legal to use a spear gun. The point of this was to remove "gig or <br />any other type of hand held spear" from the ordinance. <br />Mr. Cosentino stated the Texas Parks and Wildlife allows the use of spear guns <br />in fresh water to take non -game species. Our ordinance prohibits spear guns in <br />the river and this is where our ordinance conflicts with State law. <br />Mr. Cosentino stated there will be a need to amend other sections of the San <br />Marcos City Code as a result of changes in state law, effective on September 1, <br />2021, that will allow the open or concealed carry of handguns by both licensed <br />and unlicensed individuals. Staff is currently reviewing those code sections and <br />will bring back proposed code amendments at a future council meeting. At this <br />meeting there are currently three options in the packet regarding spear guns. <br />The options are different, but only slightly. The permit requirement is the key <br />difference between Option 1 and 2: <br />Option 1: Inserts possession of a weapon into Section 58.048; Strikes San <br />Marcos River and inserts "on City Owned Property"; Strikes gig; Strikes the <br />permit requirement <br />Option 2: Inserts possession of a weapon into Section 58.048; Strikes San <br />Marcos River and inserts "on City Owned Property"; Strikes gig; Leaves the <br />permit requirement <br />Option 3: Repeals Section 58.068 <br />Deputy Mayor Pro Tem Scott would like to strike through the words "hand <br />held spear or projectile". Council provided consensus to move forward with <br />this suggestion. <br />Mayor Hughson would like to retain the requirement of a permit in the <br />ordinance. Council provided consensus to move forward with this suggestion. <br />Staff will bring an ordinance forward with the requested changes in a redline <br />format. <br />29. Hold discussion related to the requirement for all City Council Members and Planning & <br />Zoning Commission to complete a CODE SMTX training, and provide direction to the <br />City Manager. <br />Mayor Pro Tem Derrick would like to set requirements for training to <br />understand the complete Land Development Code and would like to see some <br />type of training module implemented. <br />City of San Marcos Page 20 <br />
