Mr. Drew Wells <br /> August 15, 2022 <br /> Page 8 <br /> and observations are not intended to be an exhaustive check or a detailed <br /> inspection of the Contractor's work. Observations are to allow LUCK <br /> Design Team or its assigns, as experienced professionals, to become <br /> generally familiar with the Work in progress and to determine, in general, <br /> if the Work is proceeding in accordance with the Contract Documents. <br /> We anticipate that an average of one site visit every two weeks (for two <br /> hours each visit) will be made during the construction phase of the project, <br /> which is projected to last six months. A total of eight construction site <br /> visits is included in this scope of services. <br /> LUCK Design Team shall not be responsible for any acts or omissions of <br /> the Contractor, subcontractor, any entity performing any portions of the <br /> Work, or any agents or employees of any of them. LUCK Design Team <br /> does not guarantee the performance of the Contractor and shall not be <br /> responsible for the Contractor's failure to perform its Work in accordance <br /> with the Contract Documents or any applicable laws, codes, rules, or <br /> regulations. <br /> The design team will recommend to the Owner that Contractor's work be <br /> disapproved and rejected while it is in progress if, based on such <br /> observations, LUCK Design Team believes that such work will not <br /> produce a completed Project that conforms generally to the Contract <br /> Documents or that it will prejudice the integrity of the design concept of <br /> the completed Project as a functioning whole as indicated in the Contract <br /> Documents. <br /> The design team will issue necessary clarifications and interpretations of <br /> the Contract Documents as appropriate to the orderly completion of <br /> Contractor's work. Such clarifications and interpretations will be <br /> consistent with the intent of and reasonably inferable from the Contract <br /> Documents. LUCK Design Team may issue Field Orders authorizing <br /> minor variations from the requirements of the Contract Documents. <br /> We will recommend Change Orders and Work Change Directives to the <br /> Owner, as appropriate, and prepare Change Orders and Work Change <br /> Directives as required and determine the appropriate pay amounts due <br /> Contractor, based on observations by LUCK Design Team or its assigns, <br /> as experienced and qualified design professionals and on review of <br /> Applications for Payment and accompanying supporting documentation. <br />
