INTERLOCAL AGREEMENT BETWEEN THE CITY OF SAN <br /> MARCOS, TEXAS AND HAYS COUNTY, TEXAS FOR 2022 BYRNE <br /> JUSTICE ASSISTANT GRANT (JAG) PROGRAM AWARD <br /> This Agreement is made and entered into on Ff'4,I , 2023 (the "Effective Date") by <br /> Hays County, acting by and through its governing body, the Commissioners' Court ("County") <br /> and the City of San Marcos, a Texas home rule municipality, acting by and through its governing <br /> body,the City Council ("City"). <br /> WHEREAS, the U.S. Department of Justice requires that entities in a disparate allocation of <br /> Justice Assistance Grant (JAG) funding enter into an Agreement to provide for the use of those <br /> funds awarded; and <br /> WHEREAS, the JAG Program award is designed to provide units of local government with <br /> additional personnel, equipment, supplies, contractual support, training, technical assistance, and <br /> information systems for criminal justice; <br /> WHEREAS,this Agreement is under the authority of the Interlocal Cooperation Act, Chapter <br /> 791 of the Texas Government Code, as amended; and <br /> WHEREAS, each governing body, in performing governmental functions or in paying for the <br /> performance of governmental functions hereunder, shall make that performance or those payments <br /> from current revenues legally available to that party; and <br /> WHEREAS, each governing body finds that the performance of this Agreement is in the best <br /> interest of both parties, that the undertaking will benefit the public, and that the division of costs <br /> fairly compensates the performing party for the services of functions under this Agreement; and <br /> WHEREAS,the City seeks an allocation of$20,859 from the JAG award, and the County has <br /> declined funding allocation and believes it to be in its best interest to allow the City to receive the <br />
