<br />122 <br /> <br /> <br /> <br /> <br />Regular Meeting March 25, 1991 Page 3 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN EARNEST MONEY <br />CONTRACT BETWEEN THE CITY OF SAN MARCOS AND GENLYTE GROUP, INC. <br />D/B/A WIDELITE FOR THE PURCHASE OF REAL PROPERTY AND <br />IMPROVEMENTS AT 2300 SOUTH IH35¡ AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE CONTRACT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF CONTRACT NO. <br />700068 BETWEEN THE CITY OF SAN MARCOS AND THE TEXAS DEPARTMENT <br />OF COMMERCE FOR A COMMUNITY DEVELOPMENT PROGRAM; AUTHORIZING <br />THE CITY MANAGER TO ACT IN ALL MATTERS REGARDING THIS TEXAS <br />COMMUNITY DEVELOPMENT PROGRAM CONTRACT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration award of bid for a <br />two-door utility Vehicle for the Police Department. Ms. Kissler <br />moved to award bid to Fiesta Lincoln Mercury Dodge in the amount of <br />$15,691.45 and Mr. Moore seconded the motion, which passed <br />unanimously. <br /> <br />Mr. Moore moved the Council pull Item 5.A., approval of the minutes <br />of the Regular Meeting held March 11, 1991 from the consent agenda <br />and that the minutes be rescheduled when a majority of Council <br />Members are present to vote approval of the minutes and Mr. <br />Hernandez seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: Moore, Hernnadez, Morris, Kissler, Plummer. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Guerra (Mr. Guerra present at 7:53 p.m.). <br /> <br />Mayor Morris introduced for discussion and consideration the salary <br />and responsibilities pertaining to the Municipal Court Judge and <br />Municipal Court Judge Alternate. Marcos Hernandez resigned from <br />serving as a Municipal Court Judge Alternate. Vince Luizzi <br />continues as a Municipal Court Judge Alternate magistrating one <br />weekend per month under contract in the amount of $175.00 monthly. <br />The Municipal Court Judge, Ross Allegro, is now magistrating two <br />weekends per month. Marcos Hernandez was paid $500.00 under <br />contract to magistrate two weekends per month. Judge Allegro's <br />salary is currently $38,147.00 and is requesting the funds that were <br />previously paid to Marcos Hernandez in the amount of $500.00 a month <br />be transferred to salaries for Judge Allegro to be paid for this <br />magistration. Mr. Plummer moved to transfer the contracted funds of <br />$500.00 a month to the salaries line item for Judge Allegro to be <br />paid for magistrating two weekends per month retroactive to December <br />8, 1990 and Mr. Moore seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced a discussion regarding the B.F.I. <br />proposal for initiating a residential curbside recycling program and <br />direction to Staff. Mr. Gilley stated some advantages in going with <br />the BFI proposal would be we could begin recycling in San Marcos <br />more quickly, it could run concurrently with BFI's present contract <br />with the City, which has 18 months remaining, it would give the City <br />time to evaluate the services of BFI and how they meet the needs of <br />our community, and it would be a good opportunity to begin the <br />recycling process with a minimum expense to the citizens (estimated <br />$1.50 per household per month plus 8 cents per container, which <br />would be provided by BFI). Mayor Morris expressed interest in going <br />with BFI's proposal but recommends Staff have a RFP ready a year <br />from now to explore what the best options for the citizens are. Mr. <br />Hernandez wants the City to receive RFPs now to see what all vendors <br />have to offer. Mr. Guerra agreed with Mayor Morris' suggestion. <br />Staff indicated there needs to be time to educate the citizens on <br />recycling. It was consensus of Council to go with the BFI proposal <br />now, receive a report from Staff after it is in operation for six <br />months, tie down BFI's price as quickly as possible, and go through <br />the RFP process in the future. Staff will bring the needed <br />amendments to the Council for consideration at the next meeting. <br />
