<br />52 <br /> <br /> <br /> <br />Regular Meeting July 8, 1991 Page 4 <br /> <br /> <br />TEXT AND ADDING PROVISIONS TO ALLOW AN EXISTING DWELLING OR <br />MOBILE HOME TO TEMPORARILY REMAIN ON A RESIDENTIAL LOT ZONED <br />"R-1", "R-2", OR "MR" DURING THE CONSTRUCTION OF A NEW <br />SINGLE-FAMILY DWELLING ON THE SAME LOT; REPLACING THE TERM <br />"FIREWALL" WITH A MORE ACCURATE DESCRIPTION AND AMENDING THE <br />RESTRICTIONS ON FENCES AND OTHER OBSTRUCTIONS; AMENDING SECTION <br />37 REGARDING MINIMUM OFF-STREET PARKING REQUIREMENTS FOR EATING <br />AND DRINKING ESTABLISHMENTS; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br />PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Hart moved for approval of the Ordinance on second reading and <br />Mr. Plummer seconded the motion. Mr. Moore expressed concern for <br />the generality in defining under permitted uses administrative <br />offices and fraternal buildings. Mayor Morris moved to amend the <br />Ordinance on Page 3, section 1, to clarify the following <br />definitions: (40) Fraternal building is any building occupied and <br />maintained as meeting facilities by the members and guests of a <br />social club organization or association but not including <br />residential facilities or sleeping quarters and not occupied and <br />maintained by a social association of college students. (41) A <br />fraternity or sorority building is any building occupied and <br />maintained by a social association of college students. Mr. Plummer <br />seconded the motion, which passed unanimously. Mayor Morris moved <br />to amend the Ordinance on Page 3, Section 2 to delete recreational <br />facilities from public use, because it is redundant, and Mr. Hart <br />seconded the motion, which passed unanimously. Mayor Morris moved <br />to amend the Ordinance to include the recommended amendments of Mr. <br />Taylor to provide more clarity to the Ordinance by amending section <br />1(105), Section 2(1), section 3(A) (8), section 4, 30(A) (1) and (5), <br />section 6(A) (2) and 6(B) (1), section 12, 36(D) and 36(D) (4), and Mr. <br />Moore seconded the motion, which passed unanimously (Mr. Taylor's <br />recommended amendments were provided to the Council in their <br />packets). The Council then voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 12-8 OF THE SAN MARCOS CODE OF <br />ORDINANCES TO INCREASE THE RESIDENTIAL SOLID WASTE COLLECTION <br />RATE AND TO BROADEN THE PURPOSES FOR USE OF THE SOLID WASTE <br />RESERVE FUND; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES¡ PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Mr. Plummer seconded the motion. Mr. Gilley stated the <br />reserve fund uses are for the purchase of a future landfill, testing <br />at the closed landfill site, monitoring of wells, and absorbing some <br />rate increases. The Council voted unanimously for adoption of the <br />Ordinance on third and final reading. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was <br />read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 12-8 OF THE SAN MARCOS CODE OF <br />ORDINANCES TO INCREASE THE RESIDENTIAL SOLID WASTE COLLECTION <br />RATE TO PROVIDE FUNDING FOR RECYCLING SERVICES; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A <br />PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the amendment. R. G. Phillips indicated this <br />program would be a waste. Bill Coddington does not think the <br />service will be utilized by citizens. Martha Latta stated recycling <br />is inevitable and is in hopes residents will use the one-year pilot <br />recycling program because it will be convenient. No one else wished <br />
