is: 1) consistent with the intent of the zone; and 2) compatible with other listed <br />permitted uses. <br />5. Non -Conforming Uses of Land — Where, as of the time of the Submittal date, a <br />lawful use of land exists which would not be permitted by the regulations <br />imposed by this PDD, such use may continue so long as it remains otherwise <br />lawful, provided: <br />• No such non -conforming use shall be enlarged or increased nor extended to <br />occupy a greater area of land than was occupied on the Submittal date of <br />adoption or amendment of this PDD. <br />• No such non -conforming use shall be moved, in whole or in part, to any <br />portion of the lot or parcel other than that occupied by such use at the <br />Submittal date of adoption or amendment of this PDD. <br />• If any such non -conforming use of land ceases for any reason for a period of <br />more than 180 days, any subsequent use of such land shall conform to the <br />regulations specified by this PDD for the district in which such land is located. <br />• No additional structure not conforming to the requirements of this PDD shall <br />be erected in connection with such non -conforming use of land. <br />6. Non -Conforming Structures — Where a lawful structure exists on the Submittal <br />date of adoption or amendment of this PDD that could not be built under the <br />terms of these regulations by reason of restrictions on area, height, yards, its <br />location on the lot, or other requirements concerning the structure; such structure <br />may be continued so long as it remains otherwise lawful, provided: <br />• No such non -conforming structure may be enlarged or altered in a way, which <br />increases its non -conformity, but any structure or portion thereof may be <br />altered to decrease or have no effect on its non -conformity. <br />• Should such non -conforming structure or non -conforming portion of structure <br />be destroyed by any means to an extent of more than 50 percent of its <br />replacement cost at time of destruction, it shall not be reconstructed except in <br />conformity with the provisions of this PDD. <br />• Should such structure be moved for any reason for any distance whatsoever, <br />it shall thereafter conform to the regulations for the district in which it is <br />located after it is moved. <br />7. At the time of site plan review, plans for all developments shall be submitted <br />detailing building placement and other details, which must be in conformance <br />with the PDD design guidelines for residential and/or commercial structures. <br />8. Land Use Plan Provisions — Land use designations have been assigned to each <br />area identified on the PDD (see Exhibit II-2). Land use schedule provisions for <br />the areas designated for development include land use designation, average <br />density, maximum units and estimated gross acreages. <br />-27- <br />
