• Abstract No. 2, located south of the intersection of Craddock Avenue and Bishop Street; <br />approving a service plan for this area; including procedural provisions; and declaring an <br />emergency; and consider adoption of Ordinance 2009-79. <br />Mayor Narvaiz opened the Public Hearing at 8:03 p.m. <br />Dianne Wassenich, 11 Tanglewood; San Marcos, Texas, encouraged the City Council to <br />consider the damage this annexation would do to the aquifer. <br />Steve Ramsey, with Baiker Aicklen, stated he represents the owners and was present to answer <br />any questions. <br />There being no further comments, the Public Hearing was closed at 8:08 p.m. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Terry, the City Council voted five (5) for and one (1) opposed, with Councilmember Bose voting <br />against, and Councilmember Jones absent from the dais, to approve Ordinance 2009-79, as <br />previously captioned. The motion carried. <br />23. Public Hearing to receive comments for and against an amendment to Ordinance 2008- <br />40 in order to modify the existing planned development district overlay for a 1.46 acre, <br />more or less, tract of property located at the intersection of Concho Street and LBJ Street <br />with base zoning of "GC" General Commercial District; including procedural provisions; <br />and providing for penalties; and consider adoption of Ordinance 2009-80. <br />Mayor Narvaiz opened the Public Hearing at 8:11 p.m. <br />Kyle Maysel, 109 E. Hillcrest Dr., San Marcos, Texas, Chairman of Park Advisory Board, stated <br />they are opposed to this project. He also stated he would like to see this development be <br />required to have more parking. <br />Ed Theriot, representing the owners, provided the City Council with the differences between the <br />original project and the changes. He stated they have been working hard with City Staff to meet <br />all the requirements of the City. <br />There being no further comments, the Public Hearing was closed at 8:18 p.m. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Couch, the City Council voted six (6) for and none (0) opposed, with <br />Councilmember Jones absent from the dais, to approve Ordinance 2009-80, as previously <br />captioned. The motion carried unanimously. <br />24. Public Hearing to receive comments for and against an amendment to the future land <br />use map from "VLDR" Very Low Density Residential, "LDR" Low Density Residential, <br />and "OS" Open Space to "MU" Mixed Use for a 101.40 acre more or less, tract of land out <br />of the J.M. Veramendi Survey No. 1, Abstract No. 17; amending the official zoning map of <br />RM121609 Minutes Page 5
