0d. Fireplaces/Chimneys. Fireplaces or chimneys which list, bulge, or <br />settle due to defective material or deterioration. Fireplaces or <br />chimneys which are of insufficient size or strength to carry <br />imposed loads with safety; <br />e. Weather Protection. Deteriorated or ineffective waterproofing of <br />exterior walls, roofs, foundations or floors, including broken <br />windows or doors. Defective protection or lack of weather <br />protection for exterior wall coverings, including lack of paint, or <br />weathering due to lack of paint or other protective covering. Any <br />fault or defect in the building which renders same structurally <br />unsafe or not properly watertight. <br />f. Windows and Doors. Windows, skylight, door frames not <br />maintained in good condition and weather tight. Exterior doors not <br />maintained in good condition or not secured. <br />g. Inyress and Egress. Landing, stairs, steps, and other means of <br />ingress and egress not properly maintained or structurally unsafe. <br />(1) Identification and Enforcement <br />a. Staff will identify that a landmark's structure's or building's <br />condition falls under the criteria of Demolition by Neglect. This <br />initial identification may originate from a staff inspection of the <br />neighborhood or by citizen referral. <br />The staff shall present its findings and recommendations to the <br />Historic Preservation Commission at a public hearing with a report <br />detailing the defects which, in the staff s opinion, indicate <br />Demolition by Neglect. The owner is notified by certified mail of <br />the hearing. The Historic Preservation Commission must render a <br />decision within 45 days of the date notice of the public hearing is <br />provided to the owner, as to any finding of Demolition by Neglect <br />subject to any supplemental options under subsection (2)d. <br />C. If a finding of Demolition by Neglect is made by the Historic <br />Preservation Commission without any recommendation to exercise <br />any options under subsection 2(d), staff shall proceed under the <br />process outlined in the building ordinance to require correction of <br />defects or repairs so that such structure shall be preserved and <br />protected in accordance with the purposes of this chapter and <br />applicable building ordinances. <br />0d. If the Historic Preservation Commission renders a decision finding <br />Demolition by Neglect, it may request that the City Council
