<br />47 <br />Regular Meeting May 29, 1990 Page 4 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING CHAPTER 5 - BUILDINGS AND BUILDING <br /> REGULATIONS OF THE SAN MARCOS CODE OF ORDINANCES TO ADD <br /> SECTION 5-128(d) AUTHORIZING MASONRY PARKING UNITS FOR USE <br /> IN OFF-STREET PARKING LOT PAVEMENT CONSTRUCTION; PROVIDING <br /> FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; <br /> PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND DECLARING <br /> AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on first reading <br />and Mr. Guerra seconded the motion, which passed unanimously. <br />Mayor Morris moved to amend the Ordinance caption to read" . . . <br />AUTHORIZING MASONRY PAVING UNITS FOR USE IN OFF-STREET PARKING <br />LOT PAVEMENT CONSTRUCTION " and Mr. Moore seconded the <br /> . . . , <br />motion, which passed unanimously. The Council then voted <br />unanimously for approval of the Ordinance on first reading. <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on second reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING AND ADOPTING A CAPITAL IMPROVEMENTS PLAN AS <br /> A BASIS FOR THE IMPOSITION OF IMPACT FEES; AMENDING PORTIONS <br /> OF CHAPTER 30 OF THE SAN MARCOS CODE OF ORDINANCES <br /> PERTAINING TO THE CALCULATION, ASSESSMENTS AND COLLECTION OF <br /> WATER AND SEWAGE SYSTEM CAPITAL RECOVERY FEES TO MAKE <br /> REFERENCE TO WATER AND SEWAGE SYSTEM IMPACT FEES; AMENDING <br /> THE AMOUNTS OF THESE FEES; PROVIDING FOR CALCULATION OF <br /> THESE FEES BASED UPON SERVICE UNITS RATHER THAN LIVING UNIT <br /> EQUIVALENTS; PROVIDING FOR SEVERABILITY; REPEALING ALL <br /> CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br /> PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on second reading <br />and Mr. Hart seconded the motion. Mayor Morris moved to amend <br />Section 30-45(6) to read as Group Living Quarters instead of <br />Group Homes, and to amend Section 30-65(6) to read as Group <br />Living Quarters instead of Group Homes, and Mr. Moore seconded <br />the motion, which passed unanimously. On roll call the following <br />vote was recorded: <br /> AYE: Moore, Hernandez, Hart, Morris, Guerra, Kissler. <br /> NAY: None. <br />ABSTAIN: Plummer. <br />(Mr. Plummer present at 8:15 p.m.). <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on third and final reading, the caption which was read <br />as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING CITY REGULATIONS PERTAINING TO FLOOD DAMAGE <br /> PREVENTION; PROVIDING FOR SEVERABILITY; REPEALING ALL <br /> CONFLICTING ORDINANCES; PROVIDING FOR PENALTIES; PROVIDING <br /> FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br />Ms. Kissler moved for adoption of the Ordinance on third and <br />final reading and Mr. Moore seconded the motion. Mr. Guerra <br />moved to amend the Ordinance in Section 5.58 to substitute <br />Director of Environment and Engineering Department for Director <br />of Planning and Development Services and Mr. Hernandez seconded <br />the motion, which passed unanimously. The Council then voted <br />unanimously for adoption of the Ordinance on third and final <br />reading. <br />
