Notify <br /> the Owner in advance of such meetings for possible Owner attendance. <br /> • Report to the Owner once permits or approvals have been obtained. <br /> Task 4 Deliverables: <br /> • Draft Permitting and Approvals Plan <br /> • Updated Permitting and Approvals Plans at 30% and 60% Design Milestones <br /> • Permit Responsibility Contract Exhibit(s) <br /> Task 4 Assumptions: <br /> • Design-Builder's responsibility to support Owner in obtaining Owner-provided <br /> permits is limited to providing required technical information for the permit <br /> application. The Owner will retain responsibility for development of permit <br /> applications, fees, and communication with permitting authority. <br /> • Design Builder will conduct up to three (3) meetings in Phase 1 with TCEQ to <br /> discuss the proposed temporary systems (GMP 1), Early Works Package (GMP <br /> 2), and Balance of Plant (GMP 3) packages prior to submittal of plans and <br /> specifications to TCEQ for formal review. Failure by Design-Builder to provide <br /> required information resulting in additional meetings shall not constitute grounds <br /> for a change in price or schedule. <br /> • Permit approvals that are not required prior to the GMP(s) will be included in the <br /> GMP Scope(s) of Work, as needed. <br /> • Permits and other environmental approvals (e.g. NEPA reviews) required by <br /> WIFIA and/or CWSRF funding are not included in this scope. <br /> • Submission of TPDES permit applications for the temporary package plant and <br /> permanent plant are the responsibility of the Owner and are not included in this <br /> scope. <br /> Task 5—Survey and Field Investigations <br /> The Design-Builder may rely on any prior engineering interpretations, opinions, or <br /> recommendations that may be contained within the existing site information provided <br /> and will request additional clarification as needed from the Owner. The Design-Builder <br /> will identify, plan, and perform additional survey, including topographical and surface <br /> information, and field investigations needed to support further design development, <br /> validate existing site conditions, support permit applications, develop maintenance of <br /> 7 Exhibit B — Phase 1 Scope of Services <br />
