<br />73 <br /> <br /> <br /> <br />Regular Meeting November 5, 1990 Page 4 <br /> <br /> <br />Ms. Kissler moved for adoption of the Ordinance on third and final <br />reading and Mr. Plummer seconded the motion. The Council discussed <br />whether or not to regulate signs in the ETJ. Mr. Hernandez moved to <br />not include the ETJ in Section 1-1. Jurisdiction. The motion <br />failed for lack of a second. The Council discussed changing the <br />minimum spacing requirements in Section 2-3. Permanent Off-Premise <br />Signs. (4) (B), from 500 to 1500 feet. John Diaz advised 1500 feet <br />is not enough space in the City (too far apart). Mr. Plummer <br />suggested using 750 feet on all roads in the ETJ, then when they are <br />annexed into the City, the requirements would go to 500 feet. The <br />Council discussed amending the Ordinance to regulate all highways <br />except IH35 in the ETJ. Mayor Morris stated she wants to regulate <br />IH35 also. Mayor Morris moved to amend Section 2-3.(4) to include <br />Subsection (C) - ETJ with minimum spacing of 750 feet to include the <br />same highways listed in (B) and Mr. Moore seconded the motion, which <br />passed unanimously. Mr. Taylor stated on Page 2 of the lined copy <br />of the Ordinance (Sec. 1-3. Exempted Signs), #s (5), (6) and (10) <br />are combined and only apply to on-premise signs. It was consensus <br />of Council that is what they wanted. The Council discussed <br />standards on Page 4 in Section 2-1.(1) of the lined copy - regarding <br />the restriction that a sign cannot extend into a building setback <br />area. Mr. Taylor stated there is a restriction of one per facade <br />per premise (there should be a limitation). Mr. Plummer moved to <br />amend Section 2-1. (1) to delete the first sentence in its entirety <br />and Mr. Hernandez seconded the motion, which passed unanimously. <br />The Council discussed Section 2-3. Permanent Off-Premise Signs, <br />Subsections (6) and (7) on Page 7 of the lined copy, regarding the <br />distance requirements of 480 feet except in the highway corridor. <br />Mr. Moore stated this covers joint use of on-premise and off-premise <br />on the same ground. Jeff Hill stated this allows restructured but <br />not new signs. Mr. Hart moved to amend Section 2-3.(6) on Page 6 to <br />add new and restructured on highway'and restructured in the City and <br />Mr. Plummer seconded the motion, which passed unanimously (Mr. <br />Hernandez out of Council Chambers during vote on this amendment). <br />Mayor Morris moved to amend Section 2-4. Temporary Signs. (a) on <br />Page 7 to add the following: "Temporary signs such as banners, <br />inflatable signs, garage sale signs, and real estate and <br />construction signs, are subject. . . .", and Mr. Plummer seconded <br />the motion. Bill Thompson stated restaurants use banners and 10 <br />feet x 4 feet is small. Mayor Morris withdrew her motion and Mr. <br />Plummer withdrew his second. Mr. Plummer moved to amend Section <br />2-4. (b) (3) to change 32 square feet to 40 square feet, and Mr. Hart <br />seconded the motion, which passed unanimously. Mr. Moore moved to <br />amend Section 2-4.(a) to define temporary as garage sale signs, <br />inflatable signs, banners, inverted V signs. The motion failed for <br />lack of a second. Mayor Morris moved to amend Section 2-4.(a) to <br />add at the end of the paragraph, "Freestanding, inverted V signs are <br />permitted on sidewalks adjacent to premises within the Central <br />Business District," and Mr. Moore seconded the motion, which passed <br />unanimously. Mr. Guerra present at this time (10:09 p.m.). The <br />Council discussed if Section 3-6 on Pages 11 and 12 were acceptable <br />for an appeals and variance process. Jane Hughson stated she wants <br />a realistic appeals process. Mr. Guerra moved to amend Section 3-6 <br />on Pages 11 and 12 for a two-step process for an aggrieved person <br />denied by the Zoning Commission, to appeal to the Zoning Board of <br />Adjustments and Appeals, with Mr. Taylor to provide the wording <br />necessary, and Mr. Hernandez seconded the motion, which passed <br />unanimously. Mr. Guerra moved to amend Section 3-6 on Page 12 to <br />delete Subsections (1) and (2). The motion failed for lack of a <br />second. Mayor Morris moved to amend Section 2-4.(c) on Page 7 to <br />provide an exception for political signs and Mr. Guerra seconded the <br />motion, which passed unanimously. Subsection (10) in Section 1-6. <br />on Page 3 was added, because it is covered in the Historical <br />Preservation Ordinance. Mayor Morris moved to amend the first line <br />of Section 2-2.(5) on Page 5 to read: "A multiple-occupancy <br />premises may have ~ sign having an area up to . . .", and Mr. <br />Plummer seconded the motion, which passed unanimously. Bill <br />Thompson asked about portable signs removed for repair in Section <br />1-9 on Page 4, and Mr. Taylor stated the period of time is "a <br />reasonable period of time". Mr. Guerra moved to amend Section 1-1 <br />for the jurisdiction to be the city limits only. The motion failed <br />for lack of a second. Mr. Guerra moved to amend Section 1-6.(1) <br />
