construction contract for the City Segment shall comply with all TxDOT <br />requirements for federally funded highway projects, if applicable. <br />Article VII: County's Obligations - FM 110 -From McCarty Lane to SH 123. <br />7.1 When the Conditions Precedent in Section 4.1 have been satisfied, County will be <br />contractually obligated to City to perform the tasks set forth in this Article VII <br />pertaining to the construction of the segment of FM 110 from McCarty Lane to SH <br />123 (hereinafter "the FM 110 Segment") as depicted on a map attached to this <br />Agreement as Exhibit "B." <br />7.2 County shall pay for the design of the FM 110 Segment according to TxDOT <br />standards and the Pass Through Toll Agreement. <br />7.3 County shall acquire, at its expense, all right of way necessary for construction <br />ofthe FM 110 Segment. <br />7.4 County shall pay for the relocation of utilities along the FM 110 Segment, if <br />necessary. However, County shall not be obligated to pay for construction or <br />installation of City's Water and Wastewater utilities along the FM 110 Segment, <br />which shall be the obligation of City if, as, and when City opts to perform such <br />construction or installation. <br />7.5 County shall obtain, at its expense, environmental clearance for the FM 110 <br />Segment. <br />7.6 County shall competitively bid and award a contract for construction of theFM 110 <br />Segment that provides for its commencement within forty-eight (48) months ofthe <br />Effective Date of this Agreement and its completion with twenty-four (24) months <br />of commencement.
