<br />146 <br /> <br />regular meeting <br /> <br />march 23, 1981 <br /> <br />page three <br /> <br />Mr. Stokes introduced for consideration an Ordinance on third and final <br />reading, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 2.907 <br />ACRES OUT OF THE CHARLES DAVIS TRACT, LOCATED ON <br />LBJ DRIVE, FROM "R-2" (DUPLEX DWELLING DISTRICT) <br />TO "D" (MULTI-FAMILY DWELLING DISTRICT). <br /> <br />The City Manager stated that the developer had given the City an <br />easement for the needed right-of-way, but was going to dedicate the <br />land in fee simple to the city. J:1rs. Norris moved to adopt the Ordinance. <br />Mr. James seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Brown, Cavazos, James, Norris, Tarbutton <br /> <br />NAY: <br /> <br />None <br /> <br />ABSTAIN: <br /> <br />Stokes <br /> <br />Mr. Stokes introduced for consideration an Ordinance on third and final <br />reading, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 30 <br />ACRES OUT OF THE RIVER RUN SUBDIVISION, LOCATED ON RIVER <br />ROAD, FROM "AO" (AGRICULTURAL-OPEN SPACE DISTRICT) TO "D" <br />(MULTI-Ffu~ILY DWELLING DISTRICT). <br /> <br />Mrs. Norris moved to adopt the Ordinance. Mr. Tarbutton seconded the <br />motion. The City Manager stated that on the issue of utility extension, <br />he would like for Mr. Boyd and Mr. Salinas to get together and would <br />like for this item to be tabled. !1r. Boyd stated that he was going to <br />pay for an 8" water line to his property and that he wanted to work with <br />the City, but didn't feel that he should be required to give 100%. The <br />City D1anager stated that an on site inspection at the time of the annexatio <br />did not reflect that any structure had been started. Mr. Boyd stated <br />that a lot of engineering had to be done before construction could be <br />started. The City Manager stated that the 8" water main was needed to <br />prevent the problem of low water pressure. The area is now being served <br />with a 2" main which is inadequate. Mr. Stokes asked if the building <br />permit could be denied if utilities are inadequate. The City Manager <br />stated that he did not know if that was possible. Mr. Brown moved to <br />table this item until the April 13th meeting after Mr. Boyd and Mr. <br />Salinas meet. Mr. James seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: <br /> <br />Brown, James <br /> <br />NAY: <br /> <br />Cavazos, Norris, Tarbutton <br /> <br />ABSTAIN: <br /> <br />Stokes <br /> <br />The motion failed. On the original motion to adopt the Ordinance, the <br />following vote was recorded: <br /> <br />AYE: <br /> <br />Cavazos, Norris, Tarbutton <br /> <br />NAY: <br /> <br />Brown, James <br /> <br />ABSTAIN: <br /> <br />Stokes <br />
