146 regular meeting march 23, 1981 page three Mr. Stokes introduced for consideration an Ordinance on third and final reading, the caption of which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 2.907 ACRES OUT OF THE CHARLES DAVIS TRACT, LOCATED ON LBJ DRIVE, FROM "R-2" (DUPLEX DWELLING DISTRICT) TO "D" (MULTI-FAMILY DWELLING DISTRICT). The City Manager stated that the developer had given the City an easement for the needed right-of-way, but was going to dedicate the land in fee simple to the city. J:1rs. Norris moved to adopt the Ordinance. Mr. James seconded the motion. On roll call, the following vote was recorded: AYE: Brown, Cavazos, James, Norris, Tarbutton NAY: None ABSTAIN: Stokes Mr. Stokes introduced for consideration an Ordinance on third and final reading, the caption of which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 30 ACRES OUT OF THE RIVER RUN SUBDIVISION, LOCATED ON RIVER ROAD, FROM "AO" (AGRICULTURAL-OPEN SPACE DISTRICT) TO "D" (MULTI-Ffu~ILY DWELLING DISTRICT). Mrs. Norris moved to adopt the Ordinance. Mr. Tarbutton seconded the motion. The City Manager stated that on the issue of utility extension, he would like for Mr. Boyd and Mr. Salinas to get together and would like for this item to be tabled. !1r. Boyd stated that he was going to pay for an 8" water line to his property and that he wanted to work with the City, but didn't feel that he should be required to give 100%. The City D1anager stated that an on site inspection at the time of the annexatio did not reflect that any structure had been started. Mr. Boyd stated that a lot of engineering had to be done before construction could be started. The City Manager stated that the 8" water main was needed to prevent the problem of low water pressure. The area is now being served with a 2" main which is inadequate. Mr. Stokes asked if the building permit could be denied if utilities are inadequate. The City Manager stated that he did not know if that was possible. Mr. Brown moved to table this item until the April 13th meeting after Mr. Boyd and Mr. Salinas meet. Mr. James seconded the motion. On roll call, the following vote was recorded: AYE: Brown, James NAY: Cavazos, Norris, Tarbutton ABSTAIN: Stokes The motion failed. On the original motion to adopt the Ordinance, the following vote was recorded: AYE: Cavazos, Norris, Tarbutton NAY: Brown, James ABSTAIN: Stokes
