<br />Regular Meeting <br /> <br />September 8, 2003 <br /> <br />83. <br />Page 5 <br /> <br />the property until the front house was remodeled. Anne Greenwood stated <br />she has copies of all the meetings regarding her property. She also <br />stated she has never said this mobile home was temporarily placed until <br />the front house was remodeled. She also stated she cannot afford to <br />remodel the front house. Mr. Diaz agreed this is a tough decision. He <br />also stated he feels the Council needs to enforce City Ordinances. He <br />also stated he would like to find a way to help the Greenwoods. Ms. <br />Gree~wood stated they have tried to replace the mobile home, but they need <br />additional time to do so. Mr. O'Leary stated Staff will continue to work <br />with CDBG to find some funding to assist the Greenwoods. Mr. Thomaides <br />inquired as to the memo regarding potential assistance options. Ms. <br />Barrett stated one of the options is to subdivide and request a variance <br />for smaller lots. She stated the Greenwoods would need to do a survey and <br />plat the lots. She stated the Planning and Zoning Commission did not feel <br />the Greenwoods were seriously working on a resolution to this matter. She <br />also stated Council can grant the SUP and Staff can continue to work with <br />the Greenwoods on different steps to take regarding their options. Ms. <br />Narvaiz inquired what the Council can do. Mr. Mark Taylor stated the <br />Council has two options 1) adopt a Resolution which will grant the removal <br />of SUP, or 2) deny the appeal. Mr. Mihalkanin inquired whether the <br />Council could modify the period of the SUP or variance. Mr. Mark Taylor <br />stated the Council could deny the Resolution and then extend the time to <br />allow the Greenwoods to make some improvements. Mr. Montoya inquired what <br />is the period of time for SUPs. Ms. Barrett stated the extensions are <br />usually 3 or 5 years. Mr. Montoya stated he wants to give the Greenwoods <br />additional time. On roll call for adoption of the Resolution, the <br />following vote was recorded: <br /> <br />AYE: <br /> <br />Habingreither and Montoya. <br /> <br />NAY: <br /> <br />Narvaiz, Thomaides, Mihalkanin, Taylor and Diaz. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Adoption of the Resolution failed. Mr. Mihalkanin then moved to deny the <br />appeal and grant an SUP for one year with a review of the progress after <br />six months, and Ms. Narvaiz seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />SETTING THE TAX RATE FOR THE 2003 TAX YEAR; LEVYING TAXES FOR THE USE <br />AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY FOR THE FISCAL <br />YEAR BEGINNING OCTOBER 1, 2003, AND ENDING SEPTEMBER 30, 2004¡ <br />PROVIDING A SINKING FUND FOR THE RETIREMENT OF THE BONDED DEBT OF THE <br />CITY¡ INCLUDING PROCEDURAL PROVISIONS¡ AND DECLARING AN EMERGENCY. <br />
