LOBBYING <br />TheContractorherebycertifiesthat: <br />(i.)NoFederalappropriatedfundshavebeenpaidorwillbepaid,byoronbehalfofit,toany <br />personforinfluencingorattemptingtoinfluenceanofficeroremployeeofanyagency,aMember <br />ofCongress,anofficeroremployeeofCongress,oranemployeeofaMemberofCongressin <br />connectionwiththeawardingofanyFederalcontract,themakingofanyFederalgrant,themaking <br />ofanyFederalloan,theenteringintoofanycooperativeagreement,andtheextension, <br />continuation,renewal,amendment,ormodificationofanyFederalcontract,grant,loan,or <br />cooperativeagreement; <br />(ii.)IfanyfundsotherthanFederalappropriatedfundshavebeenpaidorwillbepaidtoany <br />personforinfluencingorattemptingtoinfluenceanofficeroremployeeofanyagency,aMember <br />ofCongress,anofficeroremployeeofCongress,oranemployeeofaMemberofCongressin <br />connectionwiththisFederalcontract,grant,loan,orcooperativeagreement,itwillcompleteand <br />submitStandardFormLLL,"DisclosureFormtoReportLobbying,"inaccordancewithits <br />instructions;and <br />(iii.)Itwillrequirethatthelanguageofparagraph(d)ofthiscertificationbeincludedinthe <br />awarddocuments <br />forallsubawardsatalltiers(includingsubcontracts,subgrants,andcontracts <br />undergrants,loans,andcooperativeagreements)andthatallContractorsshallcertifyanddisclose <br />accordingly: <br />(iv.)LobbyingCertification <br />Thiscertificationisamaterialrepresentationoffactuponwhichreliancewasplacedwhenthis <br />transactionwasmadeorenteredinto.Submissionofthiscertificationisaprerequisiteformaking <br />orenteringintothistransactionimposedbysection1352,title31,U.S.C.Anypersonwhofailsto <br />filetherequiredcertificationshallbesubjecttoacivilpenaltyofnotlessthan$10,000andnot <br />morethan$100,000foreachsuchfailure. <br />h.LEADBASEDPAINT <br />TheContractoragreesthatanyconstructionorrehabilitationofresidentialstructureswith <br />assistanceprovidedunderthisAgreementshallbesubjecttoHUDLeadBasedPaintRegulations <br />at24CFR570.608,and24CFRPart35,SubpartB.SuchregulationspertaintoallCDBGDRassisted <br />housingandrequirethatallowners,prospectiveowners,andtenantsofpropertiesconstructed <br />priorto1978beproperlynotifiedthatsuchpropertiesmayincludeleadbasedpaint.Such <br />notificationshallpointoutthehazardsofleadbasedpaintandexplainthesymptoms,treatment <br />andprecautionsthatshouldbetakenwhendealingwithleadbasedpaintpoisoningandthe <br />advisabilityandavailabilityofbloodleadlevelscreeningforchildrenunderseven.Thenotice <br />shouldalsopointoutthatifleadbasedpaintisfoundontheproperty,abatementmeasuresmay <br />beundertaken.Theregulationsfurtherrequirethat,dependingontheamountofFederalfunds <br />appliedtoaproperty,painttesting,riskassessment,treatmentand/orabatementmaybe <br />conducted. <br />i.
