B. The Contractor will furnish each residential unit with one new recycling bin. The Contractor <br />will not substitute used recycling bins during the term of this Contract for those originally <br />provided to customers. If a customer's bin is in need of replacement, however, the Contractor <br />may replace the bin with a used bin if the bin is in a condition acceptable to the Director. <br />Customers will be required to use recycling bins provided by the Contractor for setting out <br />materials for pickup. <br />C. The Contractor will not limit, except as may otherwise be noted in this Contract, the amount of <br />recyclable materials residents place out for removal. <br />D. The Contractor will notify the City of all instances where the Contractor declines to collect <br />recyclable materials and the reason for it. The Director will investigate all instances of "no <br />pickups," whether reported by the Contractor or by customers, and advise the customer of the <br />reasons, or require the Contractor to collect the material. The Director will act in reasonable <br />manner in deciding these issues, and the Director's decision will be final. <br />E. The Contractor will discontinue recyclable materials collection services to any location as set <br />forth in a written notice sent to the Contractor by the City. The Contractor will resume <br />collection service at the location on the next regularly scheduled collection day upon written <br />notice from the City. <br />F. The Contractor will use its best efforts to have all recyclable materials collected by it <br />processed at a recyclable materials separation/processing site. The Contractor will ensure that <br />any such site used by it is properly licensed or permitted by the State of Texas and other <br />governmental entities having jurisdiction. The Contractor will dispose of materials, which <br />cannot be utilized by recycling markets, at a legally licensed and permitted municipal solid <br />waste facility. The Contractor will furnish the City with a written explanation of the reasons <br />that any recyclable materials collected by it are not recycled. The Contractor may dispose of <br />any contaminated recyclable materials collected. <br />G. Should single-stream, commingled recycling become available to Texas Disposal Systems <br />during the term of this agreement, Texas Disposal Systems will give the City of San Marcos a <br />rate and options pertaining to a change to asingle-stream source of recycling for curbside <br />pickup. This change may include different size containers or bins and may change the <br />scheduled day of pickup, as well as the overall rate. A mutual agreement by the contractor and <br />the City will allow for changes or amendments to the contract. <br />H. The cost for the current service will be included in the cost per month per residential unit for <br />basic residential service. <br />1.3.3 Residential Unit Bulky Waste, Construction Debris <br />A. The Contractor will collect bulky waste and construction debris from each residential unit two <br />times per month on the same day as the regular scheduled solid waste collection. The <br />Contractor will provide the City and all residential customers with a schedule of collection <br />dates. Construction debris generated from commercial remodel and demolition is excluded. <br />B. Scheduled collection will be on the basis of advance customer calls to the city. <br />6 <br />
