MERRIMAN CABIN SERVICE CONTRACT THE STATE OF TEXAS COUNTY OF HAYS 1. Co -Sponsored Activity. The operation of the Merriman Cabin (the "Cabin") by the Heritage Association of San Marcos (the "Association") will be a co -sponsored activity of the Association and the Parks and Recreation Department of the City of San Marcos (the C4 city"). 2. Provision of Services by the Association. The Association, will, in lieu of paying usage fees to the City for the Cabin, provide supplies and interior custodial services incident to the Cabin being open to the public, as well as other services including all maintenance and repair of the Cabin in keeping with the operation of the Cabin as a historic structure and museum. 3. Scheduling of Usage by the Association. The Association will schedule reservations for usage of the Cabin by the public and may collect fees and deposits incident thereto. The Association shall provide current information to the City Parks and Recreation department concerning reservation policies and procedures, and fees and deposits. 4. Opening and Securing of Cabin by the Association. The Association will be responsible for opening and securing the Cabin and for providing other assistance to members of the public who desire a tour of the Cabin or a reservation of the Cabin for use for a cultural or educational activity. 5. Restriction on Use of Cabin. The Association agrees to restrict the use of the Cabin to cultural and educational purposes. The Association agrees to maintain the Cabin in compliance with all local ordinances, as well as with applicable state and federal laws. 0 231.
