MERRIMAN CABIN SERVICE CONTRACT <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br />1. Co -Sponsored Activity. The operation of the Merriman Cabin (the "Cabin") by <br />the Heritage Association of San Marcos (the "Association") will be a co -sponsored activity <br />of the Association and the Parks and Recreation Department of the City of San Marcos (the <br />C4 city"). <br />2. Provision of Services by the Association. The Association, will, in lieu of <br />paying usage fees to the City for the Cabin, provide supplies and interior custodial services <br />incident to the Cabin being open to the public, as well as other services including all <br />maintenance and repair of the Cabin in keeping with the operation of the Cabin as a <br />historic structure and museum. <br />3. Scheduling of Usage by the Association. The Association will schedule <br />reservations for usage of the Cabin by the public and may collect fees and deposits incident <br />thereto. The Association shall provide current information to the City Parks and Recreation <br />department concerning reservation policies and procedures, and fees and deposits. <br />4. Opening and Securing of Cabin by the Association. The Association will be <br />responsible for opening and securing the Cabin and for providing other assistance to <br />members of the public who desire a tour of the Cabin or a reservation of the Cabin for use <br />for a cultural or educational activity. <br />5. Restriction on Use of Cabin. The Association agrees to restrict the use of the <br />Cabin to cultural and educational purposes. The Association agrees to maintain the Cabin <br />in compliance with all local ordinances, as well as with applicable state and federal laws. <br />0 <br />231. <br />
