San Marcos <br /> <br />Section 30.501. <br /> <br />Application; Definition <br /> <br />(a) This subchapter applies to the City of San Marcos <br /> <br />(b) In this subchapter, "appellate courts" means the county courts at <br />law of Hays County. <br /> <br />Section 30.502. <br /> <br />Creation <br /> <br />The governing body of the city may by ordinance establish the city's <br />existing municipal court and any additional municipal courts which are <br />later created as municipal courts of record. <br /> <br />Section 30.503. <br /> <br />Jurisdiction. <br /> <br />(a) A municipal court of record has jurisdiction within the <br />territorial limits of the city in all criminal cases arising under the <br />ordinances of the city. <br /> <br />(b) The court has concurrent jurisdiction with a justice court in any <br />precinct in which the city is located in criminal cases within the <br />justice court jurisdiction that: <br /> <br />(1) arise within the territorial limits of the city; and <br /> <br />(2) are punishable only by a fine not to exceed $200. <br /> <br />(c) The court has jurisdiction over cases arising outside the <br />territorial limits of the city under the ordinances authorized by <br />Subdivision 19 of Article 1175, Revised Statutes. <br /> <br />Section 30.504. <br /> <br />Judge <br /> <br />(a) A municipal court of record is presided over by one or more <br />municipal judges selected as provided by the Charter of the City of San <br />Marcos. <br /> <br />(b) A municipal judge must be a licensed attorney in <br />must have practiced law in this state for two or more <br />be a citizen of the United States and of this state.
