<br />C. <br /> <br />D. <br /> <br />CITY OF SAN MARCOS <br /> <br />RULES AND REGULATIONS FOR ELECTRIC SERVICE <br /> <br />tLiscontinuance of Serv~ce (Cont~nued) <br /> <br />Misrepresentat~ <br /> <br />The ci ty may discontinue service wi thout notice upon the <br />discovery that the customer has made a misrepresentation to <br />the City regarding the use of a electric service or has in <br />any manner fraudulently entered into the service contract. <br /> <br />Unlawful Use of Service <br /> <br />(3) <br /> <br />(1) <br /> <br />Service may be discontinued if the electric power and <br />energy is obtained in a manner defined in section 31.04 <br />of the Texas Penal Code adopted in 1973 or in an un- <br />lawful manner as determined by any governmental body <br />having jurisdiction. Compliance with any such deter- <br />mination, order, or directive will relieve the City <br />from any liability associated with the discontinuance <br />of service. Payment of all amounts for which the City <br />has not been compensated, including interest and other <br />charges incurred in rendering service to the customer <br />whether or not specifically stated in the applicable <br />rate schedule, shall be due and payable at the time of <br />discontinuance of service. <br /> <br />(2) <br /> <br />In cases of meter tampering or bypassing of meter, <br />electric energy consumed, but not metered, may be <br />estimated by the City based on amounts used under <br />similar conditions, or by other methods as approved by <br />the city. <br /> <br />The City may charge for all labor, material and equip- <br />ment necessary to repair or replace all equipment dam- <br />aged due to metertamperinq or bypassing of meter. <br />
