this project would be for single family residential dwellings and would be <br />equivalent to 8.1 acres. In the event that the parkland dedication requirements <br />for the number of dwelling units on the property exceeds the proposed parkland <br />dedication, a fee -in -lieu of parkland dedication will be required in accordance with <br />the requirements of the City of San Marcos. <br />The unique configuration of the Project Site allows for the development of the <br />property as a single project or for each area to be developed separately. The <br />area indicated as Park, Recreation and Open Space Easement may be <br />dedicated and conveyed to the City as parkland subject to the approval of the <br />Planning and Zoning Commission. Any dedication and conveyance of parkland <br />to the City would occur with the first final plat for the area being developed within <br />the Project Site. <br />Additionally, a park development fee of $18,000 will be required to assist in the <br />development of a Disc (Frisbee) Golf Course within the proposed Park, <br />Recreation and Open Space Easement area. The payment of the park <br />development fee will be required upon approval of the first final plat for the <br />property. Should the Park, Recreation and Open Space Easement be provided, <br />the method of transfer to the City shall be substantially in the form of the attached <br />Exhibit "A" known as the Retreat on Willow Creek PDD Park, Open Space and <br />Recreation Easement document. Otherwise, dedication will be through fee <br />simple title to the City for parkland. <br />The Property Owner shall be responsible for constructing a park and emergency <br />access road through the Park, Recreation and Open Space easement to connect <br />Area 1 and Area 2 within the Project Site. The park and emergency access road <br />will be a low- impact at grade road constructed, owned and maintained by the <br />Property Owner and is intended to provide direct connection between each Area <br />within the Project Site and the proposed park, recreation and open space <br />dedication area. In the event that the Park, Recreation and Open Space <br />Easement is conveyed to the City as parkland, the park and emergency access <br />road will be conveyed to the City and shall be owned and maintained by the City. <br />The property owner of each area shall be responsible for ensuring access <br />through each area to the park and emergency access road. The park and <br />emergency access road will provide emergency access to each area within the <br />Project Site and access to the Parks, Recreation and Open Space easement <br />area for City Parks Department maintenance vehicles. The final design and <br />location of the park and emergency access road shall be subject to the joint <br />approval of the Director of the Parks and Recreation Department, the Director of <br />Development Services, upon review and approval of the Permit Center Manager, <br />and the Property Owner. <br />The Property Owner will be responsible for maintenance of the Park, Recreation <br />and Open Space Easement except for those facilities associated with the <br />proposed Disc Golf Course including, but not limited to, tee boxes, landscaping, <br />Planned Development District 13 11/03/09The Retreat on Willow Creek <br />
