<br />unqualified to perform the duties of the position, the <br /> <br />employee shall be returned to the former position and <br /> <br />rate of pay. <br /> <br />If the former position is not available, <br /> <br />the employee shall be placed in a similar position or if <br />no such position is available, the employee may be <br /> <br />terminated <br /> <br />I. <br /> <br />REINSTATEMENT <br /> <br />An employee is eligible for reinstatement if: <br /> <br />1. <br /> <br />employee is returning from a military duty leave of <br /> <br />absence, or; <br /> <br />2. <br /> <br />previously incapacitated employee is no longer <br />incapacitated and employee remains otherwise <br /> <br />3. <br /> <br />qualified to perform duties of job, or; <br />employee is being rehired after having been laid off. <br /> <br />Reinstatement allows the person to maintain his previous <br /> <br />regular status for recording leave, stability accrual and <br /> <br />TMRS. <br /> <br />J. <br /> <br />PROMOTIONS <br /> <br />A promotion is the assignment of an employee from a <br />position in one classification to a position in another <br /> <br />job classification having a higher starting salary. <br />Promotional opportunities will be provided whenever <br /> <br />possible to City employees, therefore, the selection <br />process may, at the discretion of the Department <br /> <br />Director, be limited to qualified City employees. <br /> <br />-11- <br />
