Regular Meeting January 12, 2004 Page 4 Mayor Habingreither introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A 4.485 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED AT 2260 IH-35 SOUTH FROM "I~ INDUSTRIAL DISTRICT TO ~C-2" HEAVY COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. 1) Steve Holland stated he is representing the applicant and is present to answer any questions. Mayor Habingreither asked if anyone wished to speak. No one did, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved for adoption of the Zoning Ordinance and Mr. Taylor seconded the motion. Carroll Barrett, Director of Planning and Development, stated this property is currently zoned Industrial. She stated the property owner is requesting this property be rezoned to Heavy Commercial. She also stated allows the development of a mini-storage facility and warehouses. On roll call the following vote was recorded: AYE: Narvaiz, Habingreither, Taylor and Diaz. NAY: Thomaides, Mihalkanin and Montoya. ABSTAIN: None. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved for adoption of the Zoning Ordinance and Mr. Thomaides seconded the motion, which passed unanimously.
