<br />I <br /> <br />I <br /> <br />I <br /> <br />regular. meeting, may 21, 1979 <br /> <br />page three <br /> <br />121 <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />CHAPTER 23 OF THE CODE OF ORDINANCES OF <br />SAID CITY, ENTITLED "PUBLIC UTILITIES", <br />BY REPEALING ARTICLE I, ENTITLED "IN <br />GENERAL" OF SAID CHAPTER, AND SUBSTITUT- <br />ING IN ITS PLACE A NEW ARTICLE I, ENTITLED <br />"PLACEMENT OF ACVERTISEMENTS, HANDBILLS, <br />CIRCULARS, POSTERS, OR PIECES OF PAPER <br />ON UTILITY POLES WITHIN THE CITY OF <br />SAN MARCOS, TEXAS;" DESIGNATING PERSONS <br />TO BE RESPONSIBLE FOR REMOVING ADVERTISE- <br />MENTS, HANDBILLS, CIRCULARS, POSTERS, OR <br />PIECES OF PAPER FOUND ON UTILITY POLES <br />WITHIN THE CITY OF SAN MARCOS, TEXAS, <br />SUBSEQUENT TO THE EFFECTIVE DATE OF THIS <br />ORDINANCE; AND SETTING AN EFFECTIVE DATE. <br /> <br />Mr. Breihan moved the ordinance be approved on second reading. <br />Mr. Hyatt seconded the motion. Mr. James requested considera- <br />tion of a proposal to keep the current ordinance allowing <br />placement of advertising material on utility poles and raisinq <br />the deposit to $100.00 with $25.00 being kept for handling <br />expenses. It was noted that several letters had been presented <br />by central business district merchants who encouraqed Drohibition <br />of the use of utility poles for advertising as well as a letter <br />from representatives of the San Marcos Telephone Company who <br />stated that the current practice of affixing materials to <br />telephone poles presented certain safety hazards to their <br />employees. Mr. Tenorio moved to amend the preamble of the <br />ordinance to add a section stating that another reason for the <br />passage of the ordinance under consideration was a concern for <br />the safety of persons working on the utility poles. Mr. Hansen <br />seconded the motion to amend. On roll call, the following vote <br />was recorded: <br /> <br />I <br />AYE: Sutton, Tenorio, Breihan, Hyatt, <br />Hansen <br />NAY: Cavazos, James. <br /> <br />On the motion to approve the ordinance, as amended, on second <br />reading, the vote was: <br /> <br />AYE: Tenorio, Breihan, Hyatt, Hansen, <br />Sutton <br />NAY: Cavazos, James. <br /> <br />The Mayor introduced discussion of a lease agreement for <br />underground field storage at San Marcos Municipal Airport. <br />Col. Jack Stovall, Chairman of the Municipal Airport Commission, <br />came before the Council to say that the tanks had not been used <br />for some time and that due to this fact, rehabflita~{on of the <br />tanks would be necessary. Mr. Stovall said that Smith Oil <br />Distri,buting Company would aqree~nder the terms of their contract <br />to put the tanks in order at thei own expense and pay the City <br />a lease f~e of $300.00 per month r a term of one year. <br />Mr. Bill M~tague was present to r present Smith Oil Distributing <br />Company. Mr,. Tenorio asked if that\company might be willing to <br />use the airport tanks for storage o~ a more dangerous fuel <br />currently being stored within the City limits. Mr. Montague <br />replied that he could make no committ~ent but would be willing <br />to discuss the situation. The Mayor directed the City Manager <br />to proceed with drawing up a lease agr~ement for future Council <br />approval. \ <br /> <br />The Mayor introduced consideration of adkinistrative procedures <br />for council-Mayor-city Manager communications. Mr. Hansen <br />referred to a memorandum he had earlier distributed to the <br />City Council Members which set up such a procedure. Mr. Hyatt <br />requested that it be amended to provide for a time limit for <br />
