<br />12~ <br /> <br />regular meeting, may 29, 1979 <br /> <br />page two <br /> <br />in trade for a like amount of right-of-way on Ranch Road 12. <br />Dr. Jack Byrom, representing the San Marcos Baptist Academy <br />who would receive the abandoned portion of the street, <br />informed the Council that the public had no real interest in <br />Grace Street since it had never been used and was entirely <br />surrounded by Academy property and that it was not in the <br />best interest of the Academy to trade large portions of land <br />along Ranch Road 12. On roll call, the motion to approve the <br />ordinance on ftrst reading passed with the following vote: <br /> <br />AYE: Hyatt, Hansen, James, Sutton, <br />Breihan <br />NAY: Tenorio, Cavazos. <br /> <br />I <br /> <br />The Mayor read the caption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING A <br />CONTRACT FOR SERVICES BETWEEN HAROLD V. <br />SIMPSON AND COMPANY AND THE CITY OF <br />SAN MARCOS, TEXAS, PROVIDING FOR AUDIT <br />AND OTHER ACCOUNTING SERVICES AND <br />AUTHORIZING THE MAYOR OF THE CITY TO <br />EXECUTE SAID CONTRACT ON BEHALF OF THE <br />CITY. <br /> <br />Mr. Cavazos moved the resolution be adopted. Mr. Sutton <br />seconded the motion which passed unanimously. <br /> <br />Mr. Joe Cox, representing Mr. Doyle Scott, came before the <br />City Council with a request for an increase in taxi fares. <br />Mr. Cox said the rate request was based on the increase in <br />gas prices and cost of repairs to vehicles. Mr. Hyatt moved <br />to direct the City Attorney to prepare an ordinance to <br />approve the rate increase and that the item be placed on I <br />a future Council agenda for consideration. Mr. Breihan <br />seconded the motion which passed unanimously. The Mayor <br />introduced for consideration the prohibition of placement <br />of advertising material on utility poles. At the recommenda- <br />tion of the City Attorney, the ordinance was read in its <br />entirety before being considered on third reading due to the <br />fact that it had been amended at the last regular meeting. <br />Following the reading of the ordinance, Mr. Breihan moved <br />to adopt the ordinance on third and final reading. Mr. Tenor1o <br />seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: Sutton, Tenorio, Breihan, Hyatt, <br />Hansen <br />NAY: Cavazos, James. <br /> <br />In a related item, the City Attorney recommended that a <br />notice be placed in the newspaper advising persons who had <br />put up deposits for placement of advertising materials on <br />utility poles and had not been refunded those deposits to <br />contact the City concerning their disposition. Mr. Tenorio <br />moved such a notice be authorized. Mr. Hansen seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: Tenorio, Breihan, Cavazos, Hyatt, <br />Hansen, Sutton <br />NAY: James. <br /> <br />I <br /> <br />The Mayor introduced for discussion amendment of the General <br />Zoning Ordinance with regard to the C-2 (Commercial-Sale of <br />Alcoholic Beverages for On-Premises Consumption) zoning <br />classification. Mr. Ben Archer, representing the San Marcos <br />Tavern Owners and Operators Association and the Attorney for <br />the association, Mr. Robin Pearcy, came before the Council <br />to state that they felt the current tavern owners and operators <br />had already complied with City regulation and that it seemed <br />unfair to require them to comply with new regulations. <br />
